Previous issue date: 2014-12-17 / O presente trabalho tem por objeto a verificação da implementação da justiça restaurativa no
contexto brasileiro, especialmente na seara penal, como medida de efetivação do acesso à
justiça. Isto é, a partir da compreensão de que a manutenção do foco do aparato estatal na
retribuição penalizadora perpetua o revanchismo entre agredido e agressor, no lugar de
assegurar a pacificação social, indaga-se se a proposta restaurativa pode representar um
caminho mais apto a lograr o ideal de acesso à justiça. Para tanto, busca-se, inicialmente,
conceituar o modelo restaurativo de resposta ao crime, comparando-o, na oportunidade, com o
paradigma retributivo. Operadas as distinções e erigidas as características principais da
proposta restaurativa, pretende-se investigar de que maneira este modelo ganha aplicação
prática no contexto brasileiro, especialmente na seara penal, bem como o modo pelo qual ele
se encontra sob influência da noção de acesso à justiça, isto é, tenciona-se aferir o grau de
compatibilidade entre o modelo restaurativo e o referido ideal de caráter constitucional.
Considerando-se, assim, que, enquanto baliza mestra da teoria processual brasileira, a meta do
acesso à justiça preconiza a produção de resultados juridicamente justos, pretende-se observar
sua aplicabilidade no bojo do discurso principiológico do modelo restaurativo de gestão de
conflitos, compreendido este como método de implementação dos direitos humanos. / The present work aims at the verification of the implementation of restorative justice in the
Brazilian context, especially in criminal harvest, as a measure of effective access to justice.
That is, from the understanding that maintaining the focus of the state apparatus in punitive
retribution perpetuates revanchism between aggressor and aggressed in place to ensure social
peace, asks whether restorative proposal may represent a more effective way to achieve the
ideal of access to justice. To this end, we seek to initially conceptualize restorative response to
crime model by comparing it chanced, with the retributive paradigm. Distinctions erected and
operated the main features of restorative proposal, we intend to investigate how this model
gains practical application in the Brazilian context, especially in criminal harvest as well as
the way it was under the influence of the concept of access to justice, namely, it intends to
assess the degree of compatibility between the model and the ideal restorative referred
constitutional character. Considering, therefore, that while the Brazilian master beacon
procedural theory, the goal of access to justice suggests the production of legally fair results,
we intend to observe its applicability in the midst of principiológico speech restorative model
of conflict management, understood this as a method of implementation of human rights.
