justice suitable to the contemporary brazilian reality; demonstrating, then, the function of the
Civil Process at the accomplishment of this justice; detaching the importance of the law s
operators, more specifically of judges, in realize its. Therefore, this dissertation presents a
philosophical and semiotic analysis, of the role of the judges in achieving justice through the
decision-making process, presenting the phenomenon of Judicial Activism as a result of such
activity. For this, we studied the theories of authors such as Chaim Perelman, Ronald
Dworkin, Robert Alexy, Charles Sanders Peirce, among others / A partir do estudo da noção de justiça, o presente trabalho identifica uma concepção de justiça
adequada à realidade brasileira contemporânea; demonstrando o papel do Processo Civil na
realização dessa justiça e destacando a importância dos operadores do Direito,
especificamente os juízes, para a realização da mesma. Diante disso, esta dissertação
apresenta uma análise filosófica e semiótica, da atuação dos magistrados na consecução da
justiça, por meio do processo decisório, apresentando o fenômeno do Ativismo Judicial como
consequência de tal atividade. Para isso, estudamos as teorias de autores como Chaïm
Perelman, Ronald Dworkin, Robert Alexy, Charles Sanders Peirce, entre outros
