Previous issue date: 2004 / Resumo: As lesões provocadas ou geradas no ser humano, necessitam de um exame denominado exame de corpo de delito. Este visa fomecer à autoridade Policial e/ou Judicial informações sobre a gravidade ou não de um caso. Se a injúria acometer o aparelho estomatognático, este deve ser realizado por um perito Odonto-Legista. Em vista desta necessidade, revisou-se os laudos dos arquivos do Instituto Médico-Legal Afrânio Peixoto-Rio de Janeiro, realizados no período de janeiro de 2001 a dezembro de 2002 e constatou-se a realização de 837 exames. Após a compilação dos dados apurou-se que os indivíduos mais acometidos por lesões do complexo estomatognático são os do gênero masculino, na faixa etária entre 16 a 35 anos de idade e as principais causas das lesões foram geradas por socos, atropelamentos, acidentes automobilísticos, dentre outros, a área da face mais atingida foi a da maxila e os dentes mais envolvidos foram os incisivos superiores, estes em geral são acometidos de fraturas coronárias, mobilidade e avulsões e a face por equimoses e escoriações. Verificou-se nítido predomínio de fraturas coronárias dos elementos dentários da bateria labial, que resultam em "debilidade permanente da função mastigatória" associada à "deformidade permanente", conseqüências consideradas respectivamente grave e gravíssima sob o ponto de vista didático (Artigo 129 do Código Penal Brasileiro, parágrafos 1 ° e 2°). Deve-se destacar que a nível de literatura, esta área, tem sido muito pouco discutida e pouco tem-se concluído sobre as perdas de elementos dentários e as suas repercussões no complexo estomatognático. Concluiu-se também que o profissional mais qualificado para a avaliação de um dano a nível do aparelho estomatognático é aquele com formação odontológica e jurídica desta forma o Odonto-Legista é o profissional indicado para o exame de corpo de delito nos Institutos Médico Legais / Abstract: The lesion challenge or produce in the man, necessity of the examination denominate of delict of body examination.
