Previous issue date: 2018-06-15 / The present work has as its theme the use of arbitration and mediation as alternative means of solving maritime and port conflicts, aiming at the elaboration of a proposal for intervention consistent in a conflict resolution center at the Pecém Industrial and Port Complex at Ceará state of Brazil. The aim is to demonstrate the importance of the maritime and port sectors, their ability to generate conflicts, as well as the usual ways of solving them, the difficulty encountered by the jurisdiction, the wide use of arbitration in the main maritime and port centers of the world, such as the first option for resolving conflicts in those sectors, as well as the increasing diffusion and use of mediation as a way of providing a non-adjudicatory form of conflict resolution. In order to fulfill this objective, experiences were analyzed in three cities, London, New York and Singapore, maritime and port centers that became reference in the use of arbitration as the main form of resolution of maritime and port conflicts. Finally, the aspects of the reality of the Brazilian maritime and port sector are discussed, as well as the current scenario of the use of alternative dispute resolution in Brazil. Finally, it is proposed an intervention in the reality of the State of Ceará, Brazil, through a proposal to create a alternative dispute resolution center especialized in maritime and port conflicts in the Industrial and Port Complex of Pecém, as a way of providing access to mechanisms for alternative resolution of conflicts between companies and professionals working in the maritime and port sectors. / A presente dissertação tem como finalidade analisar a evolução legislativa, no sentido de
desjudicialização dos litígios, privilegiando as formas alternativas de gestão de onflitos. Nesse contexto, foca-se, em especial, a legislação relativa à atividade cartorária. O legislador tem outorgado às serventias extrajudiciais funções que antes eram privativas do Judiciário,aumentando sua importância e responsabilidade nesse processo. O processo de retificação de área e registro, o usucapião, a separação judicial, o divórcio, o inventário e a própria possibilidade de a mediação e conciliação serem feitas nos cartórios são o retrato disso. Apesar do esforço do Estado neste sentido, observam-se algumas dificuldades na plena compreensão e aceitação dos institutos jurídicos em prol da desjudicialização e autogestão dos conflitos, que alcançam tanto as partes litigantes quanto os profissionais do Direito envolvidos no processo. Considerando que algumas das inovações legislativas ainda são recentes, observa-se que se tem muito a evoluir e refinar, de modo que o objetivo de diminuir
os processos litigiosos judiciais seja atendido. Após este estudo, verificou-se a possibilidade de que, com algumas adaptações e modificações normativas, em nível de provimento estadual, mais precisamente o Código de Normas do Serviço Notarial e Registral do Estado do Ceará (Provimento nº 08/2014, da Corregedoria-Geral de Justiça do Estado do Ceará), a quantidade de solução de litígios nas serventias extrajudiciais possa aumentar e se tornar mais efetiva, evitando a instauração desnecessária de processos judiciais.
