Previous issue date: 2015-12-16 / This dissertation focuses on the fulfillment of collective processes sentence and on the analysis
of collective Executive, from the perspective of the real effectiveness of the diffuse, collective
and individual rights homogeneous. The study of the theme permeates various procedural and
practical questions, from the significant differences that exist between the execution of
judgments in individual actions and collective actions. To investigate how the fulfillment of
collective judgments and that way you can ensure the effectiveness of the supervision of
collective interests, the work discusses the historical part of the collective processes and the
influences received from foreign law. Also make a study on the species of collective rights,
legislative developments, the principles applicable to the collective process, active legitimacy
issues, jurisdiction, effects of the sentence and payment of sentence. When dealing with the
particular topic, the sentence for each species of collective rights, explaining the differences
found in the bonds can t do, deliver thing and pay amount. Presents the specific legislation of
the applicable collective enforcement procedural Microsystem and the provisions of the code
of Civil procedure, used alternative. With the edition of the law n. 13.105, March 16, 2015 (the
new code of Civil Procedure), which will enter into force on March 17, 2016, the work matches
the current items and the new code. From the perspective of postpositivism and legal method
of hypothetical-deductive research, the thesis shows that the collective process has its own
characteristics and quite different from the traditional civil process, condition that requires the
application of concepts, principles and procedures specific to the utmost coincidence between
the collective right recognized by the sentence and the full compliance with the obligation. In
addition to procedural system, the effectiveness of compliance with collective judgments goes
through a real change of mentality of Jurists, that need to adapt to the characteristics of a mass
society. / A presente dissertação versa sobre o cumprimento de sentença nos processos coletivos e sobre
a análise da tutela executiva coletiva, sob a perspectiva da real efetividade dos direitos difusos,
coletivos e individuais homogêneos. O estudo do tema permeia várias indagações de ordem
processual e prática, a partir das diferenças significativas que existem entre a execução de
sentenças proferidas em ações individuais e em ações coletivas. Para investigar como se realiza
o cumprimento de sentenças coletivas e de que forma é possível assegurar a efetividade da
tutela de interesses coletivos, o trabalho aborda a parte histórica dos processos coletivos e as
influências recebidas do direito estrangeiro. Também faz um estudo sobre as espécies de
direitos coletivos, a evolução legislativa brasileira, os princípios aplicáveis ao processo
coletivo, as questões de legitimidade ativa, foro competente, efeitos decorrentes da sentença e
liquidação de sentença. Ao tratar do tema específico, expõe o cumprimento de sentença para
cada uma das espécies de direitos coletivos, explicando as diferenças encontradas nas
obrigações de fazer, não fazer, entregar coisa e pagar quantia. Apresenta a legislação específica
do microssistema processual coletivo aplicável à execução e as disposições do Código de
Processo Civil, utilizadas de modo subsidiário. Com a edição da Lei n. 13.105, de 16 de março
de 2015 (o Novo Código de Processo Civil), que entrará em vigor no dia 17 de março de 2016,
o trabalho faz a correspondência entre os artigos do atual e do novo Código. A partir da
perspectiva do pós-positivismo jurídico e do método de pesquisa hipotético-dedutivo, a
dissertação mostra que o processo coletivo possui características próprias e bastante diversas
do processo civil tradicional, circunstância que exige a aplicação de conceitos, princípios e
procedimentos específicos para a máxima coincidência entre o direito coletivo reconhecido pela
sentença e o completo cumprimento da obrigação. Além de sistema processual distinto, a
efetividade do cumprimento de sentenças coletivas passa por uma verdadeira mudança de
mentalidade dos operadores do Direito, que precisam se adequar às características de uma
sociedade de massa.
