Previous issue date: 2013-03-26 / This study, performed along the research line of Criminology and Social Control, from Pontif?cia Universidade Cat?lica do Rio Grande do Sul`s Post Graduation Program in Criminal Science, examines the effectiveness of secundary criminalization by punitive reaction to crimes of tax evasion in the last five years. The research was conducted under the Federal Regional Court of the 4th Region, beneath the joint resolutions of appeals, since they are the final analysis from the set of evidentiary proceedings. Thus, we sought to determine whether the characteristics of the white-collar criminal collaborate to impunity and, in cases of conviction, which is its effectiveness, according to the punitive models. The paper explains how the selectivity is performed to primary criminalization and recalls the punitive models since the idea of punishment to the notion of abolitionism as an alternative mean. At the end, the decisions from 2008 to 2012 were analyzed according to the central hypothesis of impunity. / A presente disserta??o de mestrado, realizada junto ? linha de pesquisa Criminologia e Controle Social, do Programa de P?s-Gradua??o em Ci?ncias Criminais da Pontif?cia Universidade Cat?lica do Rio grande do Sul, pretendeu analisar a efici?ncia da criminaliza??o secund?ria pela rea??o punitiva nos crimes de evas?o de divisas nos ?ltimos cinco anos. A pesquisa foi realizada no ?mbito do Tribunal Regional Federal da 4? Regi?o, sob as decis?es colegiadas dos recursos de apela??o, por se tratarem de ?ltima an?lise do conjunto probat?rio processual. Dessa maneira, pretendeu-se averiguar se as caracter?sticas do criminoso de colarinho branco colaboram com a impunidade e, nos casos de condena??o, qual sua efici?ncia, de acordo com os modelos punitivos. O trabalho explica como ? realizada a seletividade para a criminaliza??o prim?ria e rememora os modelos punitivistas desde a ideia do castigo at? a ideia do abolicionismo como meio alternativo. Ao final, as decis?es no per?odo de 2008 a 2012 foram analisadas de acordo com a hip?tese central da impunidade.
