Previous issue date: 2006-04-03 / A dissertação parte da análise do direito fundamental ao meio ambiente
ecologicamente equilibrado para responder a questão orientadora da pesquisa: as
áreas de preservação permanente e as reservas legais constituídas em função da
aplicação do princípio da função sócio-ambiental da propriedade rural devem ensejar
indenização ao proprietário? Para se chegar ao problema central, foram traçados
quatro objetivos. O primeiro foi abordar a mudança de paradigmas que ocorreu no
mundo, repercutindo na evolução do direito, partindo então de uma base
individualista para uma visão coletivista em que novos direitos surgiram em função
de uma nova percepção da realidade. O segundo foi analisar o direito fundamental
da propriedade privada, bem como sua evolução histórica e o princípio da função
social da propriedade. O terceiro foi analisar o direito ambiental, passando por seu
histórico, pela mudança de visão sobre o meio ambiente partindo de um
antropocentrismo puro até o momento atual e pelos seus princípios. O último
objetivo foi fazer uma releitura do direito de propriedade a luz da proteção ambiental.
Por fim, se entendeu que, em regra, a instituição de reserva legal e de área de
preservação permanente não ensejam indenização ao proprietário. / The dissertation begins from the analysis of fundamental law to environment ecology
equilibrated to answer the question of search. The permanent preservation areas and

proprietor? For you come to the central problem were traced four objectives: -The
First was approach the change of paradigms that was happened in the world
reverberating in a right evolution beginning from the single base for the collectivity
that appeared new rights in function of new reality perception. -The Second was
analysis the fundamental right of the private propriety. -The Third was analysis the
environment right passing in his historic of view changes about the environment
beginning at pure anthropocentrism till the actual moment and his principles. -The
last objective was made a reread of propriety right, the light of environment
protection. It was understood that in rule the institution of reservation right and the
permanent preservation area don't result indemnity to the proprietor.
