Previous issue date: 2014-08-07 / The right to education is a fundamental social right and is the basis of a democratic country. Its provision aims to achieve the fundamental objectives outlined by the 1988 Constitution. The aim of this work is to study the constitutional treatment of the right to education and our form of government. Our federalism, is unusual to include municipalities, affects the way the division of competence of our educational system and the financing of the different stages of school education. / O direito à educação é um direito fundamental social e é a base de um país democrático. Sua prestação almeja alcançar os objetivos fundamentais traçados pela Constituição de 1988. O objetivo desse trabalho é estudar o tratamento constitucional dado ao direito à educação e a nossa forma de Estado. O nosso federalismo, que é atípico ao incluir os municípios, repercute na forma da repartição de competência do nosso sistema educacional e no financiamento das diversas etapas da educação escolar.
