Previous issue date: 2015-12-16 / Coordenação de Aperfeiçoamento de Pessoal de Nível Superior / The objective of this thesis consists in evaluating and reflecting, upon the federal array view, about the distancing, divergences and conflicts even an overlapping between the "My house, my life" Brazilian program (PMCMV) and the housing policy, which affects the implementation and management of housing communal policy. The focus of this analysis was to comprehend the dilemmas, challenges and opportunities of housing management in Jundiaí-SP . The thesis is oriented by bibliographical research, involving analysis and incorporation of theoretical benchmarks; by documental research, consistent in the gathering and analysis of information extracted from documents at municipal, federal and state levels; by data analysis from specific processes in Jundiaí , exploited in documents and in which there was the researcher s participation and observation, that is: changing process in management in Jundiaí-SP , started in 2013; planning and review process of the Brazilian Local Plan of Social Interest Housing ‖(PLHIS); and housing production and precarious settlement urbanization in Jardim São Camilo ‖and Jardim Novo Horizonte ‖process. The analyses suggest that PMCMV, with a single solution and standardized (new homes construction) and under strong financial logic and private production, overlaps itself to the housing policy architecture and its federal array national system integrated by funds, boards and plan at federal, state and municipal levels and restricts the municipal public management role in the housing social policy field; as well as suggests that, as the housing municipal policy is structured and effective, inclusive articulated with urban policy and with the agrarian issue regulated by urban instruments applicable and effective, the municipal public management has the administrative capacity to minimize the negative aspects of PMCMV and capacity to develop other service methods and housing solution. The reflections and analyses of this thesis contribute by indicating some challenges and opportunities to the implementation of a broader housing policy, under a decentralized model, articulated with urban and social policies and directed to democratic, fair and inclusive housing management, and, as a consequence, put the municipal public power at the leading actor position in politics and housing programs, including PMCMV, in the urban space whose its planning belongs to / O objetivo desta tese consiste em avaliar e refletir, sob a ótica do arranjo federativo, sobre o distanciamento, divergências e conflitos até mesmo uma sobreposição entre o Programa Minha Casa Minha Vida (PMCMV) e a política habitacional, que repercute na implementação e gestão da política municipal de habitação. O foco desta análise foi compreender os dilemas, desafios e oportunidades da gestão habitacional de Jundiaí-SP. A tese orienta-se pela pesquisa bibliográfica, envolvendo análise e incorporação de referenciais teóricos; pela pesquisa documental, consistente na coleta e análise de informações extraídas de documentos em nível municipal e em nível federal e estadual; pela análise de dados a partir de processos específicos em Jundiaí, instrumentalizados em documentos e nos quais houve a participação e observação do pesquisador, quais sejam: processo de mudança na gestão de Jundiaí-SP iniciado em 2013; processo de planejamento e de revisão do Plano Local de Habitação de Interesse Social (PLHIS); e processo de produção habitacional e urbanização dos assentamentos precários Jardim São Camilo e Jardim Novo Horizonte. As análises sugerem que o PMCMV, com solução única e padronizada (construção de novas moradias) e sob forte lógica financeira e privada de produção, sobrepõe-se à arquitetura da política habitacional e seu arranjo federativo sistema nacional integrado por fundos, conselhos e planos em nível federal, estadual e municipal e restringe o papel da gestão pública municipal no campo da política social de habitação; como também sugerem que, na medida em que a política municipal de habitação esteja estruturada e seja efetiva, inclusive articulada com a política urbana e com a questão fundiária regulada por instrumentos urbanísticos aplicáveis e efetivos, a gestão pública municipal tem capacidade administrativa para minimizar os aspectos negativos do PMCMV e capacidade de desenvolver outras formas de atendimento e solução habitacional. As reflexões e análises desta tese contribuem ao indicar alguns desafios e oportunidades para a implantação de uma política habitacional mais ampla, sob um modelo descentralizado, articulado com as políticas urbanas e sociais e direcionado para a gestão habitacional democrática, justa e includente, e que, como consequência, coloquem o poder público municipal na posição de protagonista da política e dos programas habitacionais, inclusive do PMCMV, no espaço urbano cujo ordenamento lhe compete
