Previous issue date: 2015-06-22 / This thesis faces the issue of freedom of artistic expression. The main objective is to identify the constitutional dimension of this kind of freedom and check if there are and, if so, what are the limits of the right free expression. in artistic activity. The hypothesis raised by this survey is affirmative and that was confirmed with its development. The work has an exploratory approach that uses the technique of bibliographical and jurisprudential research in order to investigate the issue as comprehensive as possible, and bringing a contribution to new researches to be carried out daily. The theoretical background tries to present different views of domestic and foreign authors. However, in spite of demonstrating the liberal view, it has a focus on the authors who justify state intervention in order to ensure the realization of freedom. In short, it highlighted the fact that the democratic and pluralistic brazilian rule of law does not permit prior, discretionary and authoritarian censorship. Moreover, freedom of expression is not an absolute right, and has its sizing, has its sizing established based on the law. The judiciary has an important role to respond to the society s needs, observing the limits established by the Legislature, and its procedure, when appropriate, can not be considered censorship. The limits exist in the Constitution - that in democratic states, is a popular voluntary restraint instrument, since, among all social values, are elected those which build the foundational structure - in legislation and in the spontaneous formation of social groups. Henceforth, the freedom to express artistic activity can reveal its meaning connected to concepts and values established by the Constitution and the Declaration of Human Rights, without causing damage to individuals and society as a whole.
Keywords: Freedom. Expression. Art. Law. Conflicts. / A presente dissertação tem por objeto a liberdade de expressão artística. O principal objetivo é identificar qual o dimensionamento constitucional desta espécie de liberdade e verificar, se existem, quais são os limites do direito de expressar-se livremente na atividade artística. A hipótese levantada pela pesquisa é afirmativa e foi confirmada com o seu desenvolvimento. O trabalho tem um caráter exploratório que utiliza a técnica da pesquisa bibliográfica e jurisprudencial para investigar a temática da forma mais abrangente possível, possibilitando uma contribuição para novas pesquisas que devem ser cotidianamente realizadas. O referencial teórico utilizado tenta apresentar as diversas visões de autores nacionais e estrangeiros. Não obstante, apesar de demonstrar a visão liberal, apresenta um enfoque nos autores que justificam a intervenção estatal para garantir a concretização das liberdades. Em suma, é destacado o fato de que o Estado democrático e pluralista de direito brasileiro não admite a censura prévia, discricionária e autoritária. Ademais, a liberdade de expressão não é um direito absoluto e, assim como os outros direitos, tem seu dimensionamento estabelecido com base no ordenamento jurídico. O Poder Judiciário tem importante papel para responder aos anseios da sociedade, observando o dimensionamento estabelecido pelo Poder Legislativo, e, sua atuação, quando adequada, não pode ser considerada censura prévia. Os limites existem, estão na Constituição - que, nos Estados democráticos, é um instrumento de autolimitação popular, pois, entre todos os valores sociais, elegem-se quais são os que formam a estrutura fundante -, nas legislações e nas formações espontâneas dos grupos sociais. Doravante, a liberdade de expressar a atividade artística pode revelar seu sentido, conectada a conceitos e valores estabelecidos pela Constituição e pelas Declarações de Direitos Humanos, sem causar prejuízos aos indivíduos e à sociedade como um todo.
