Previous issue date: 2012-02-29 / Este trabalho teve como objetivo estudar o mínimo existencial como pressuposto à
intervenção do Poder Judiciário nas políticas públicas. O estudo envolveu a
evolução histórica da teoria da separação de poderes, tendo como referências
principais Locke e Montesquieu. Buscou-se a conceituação dos direitos humanos e
fundamentais, bem como o estudo e desenvolvimento das gerações de direitos. Foi
dada ênfase aos direitos fundamentais sociais e sua eficácia diante do mínimo
existencial. No que concerne às políticas públicas, traçou-se o escorço histórico de
seu surgimento, bem como se examinou os fundamentos de seu controle pelo Poder
Judiciário, finalizando com os fundamentos constitucionais. Por consequência,
passou-se a observar a hipótese de intervenção em políticas públicas pelo Poder
Judiciário considerando como limites a razoabilidade e a reserva do possível,
examinando, em seguida, a possibilidade de se utilizar os aparatos procedimentais
para tal intervenção. Após, buscou-se estudar o mínimo existencial diante da
inexistência da reserva do possível. A conclusão encontrada foi a comprovação de
que o mínimo existencial correspondente ao núcleo duro de cada direito fundamental
social, analisado no caso concreto, é pressuposto à intervenção do Poder Judiciário
no controle das políticas públicas. O método dialético foi adotado para o
desenvolvimento deste estudo, que teve como marco referencial teórico as ideias de
Ada Pellegrini Grinover. / This work aimed to study the minimum existential assumption as to the intervention
of the judiciary in public policy. The study involved the historical evolution of the
theory of separation of powers, with the main references Locke and Montesquieu.
We tried to the concept of human rights and freedoms, and the study and
development of generations of rights. Emphasis was placed on fundamental social
rights and their effectiveness in the face of existential minimum. With regard to public
policy, traced the history of its emergence foreshortening, as well as examined the
foundations of their control by the judiciary, ending with the constitutional
foundations. Consequently, we started to look at the possibility of intervention in
public policy by the judiciary as limits considering the reasonableness and reserve for
examining, then the possibility of using the apparatus for such procedural
intervention. Afterwards, we study the existential minimum on the lack of reserve for
contingencies. The conclusion has been found to prove that the minimum
corresponding to the existential core of each fundamental social right, analyzed in
this case, the assumption is the intervention of the judiciary in control of public
policies. The dialectical method was adopted for this study, which has the theoretical
ideas of Ada Pellegrini Grinover.
