El Concejo de Minería en la resolución N° 503-2019-MINEM/CM sentó
como precedente de observancia obligatoria que cuando un minero informal solicite
modificar la concesión que ha consignado en su IGAFOM, se deberá notificar al titular
de la concesión minera sobre la que se está solicitando traslado para que este emita su
consentimiento en un plazo de 10 días, caso contrario el procedimiento no podrá
continuar. Esto, en un intento de velar por una mejor tutela de los derechos de exploración
y explotación del titular minero de la concesión, quien se ve perjudicado cuando un
minero informal realiza actividad en su concesión sin su permiso, pues afecta el futuro
desarrollo de la actividad minera del titular minero de la concesión, además de la
extracción de los minerales que están en la misma.
Sin perjuicio de ello, cuando los titulares toman conocimiento de que se está
aprovechando su concesión sin su autorización es complicado detener la actividad; ya que
el minero informal ha podido gestionar la aprobación de su IGAFOM con ese derecho
minero consignado, y salvo que ellos tengan una autorización de inicio o reinicio de
actividad o se encuentren inscritos en el REINFO no podrán oponerse a esta por la vía
administrativa; no obstante, esto no limita las acciones civiles o penales que se encuentran
facultados a ejercer.
Por otro lado, consideramos que este precedente agrega requisitos al procedimiento de
modificación de nombre y código del derecho minero en el IGAFOM, pues, a partir de
este precedente, es obligatoria la notificación al titular minero de la concesión de traslado
y su manifestación de consentimiento exhibiendo los contratos o autorizaciones suscritas
con el minero informal. Para nosotros, este nuevo requisito puede representar una tara
para el proceso de formalización minera, ya que el obstáculo principal para culminar la
formalización es obtener los contratos de cesión o explotación de la concesión. / The Mining Council in Resolution No. 503-2019-MINEM/CM established
as a precedent of mandatory observance that when an informal miner requests to modify
the concession that has been recorded in its IGAFOM, the holder of the mining concession
on which the transfer is being requested must be notified so that it may issue its consent
within 10 days, otherwise the procedure cannot continue. This, in an attempt to ensure a
better protection of the exploration and exploitation rights of the mining concession
holder, who is harmed when an informal miner carries out activities in his concession
without his permission, since it affects the future development of the mining activity of
the mining concession holder, in addition to the extraction of the minerals that are in the
concession.
Notwithstanding, when the owners become aware that their concession is being used
without their authorization, it is complicated to stop the activity, since the informal miner
has been able to manage the approval of his IGAFOM with that mining right consigned,
and unless they have an authorization to start or restart the activity or are registered in the
REINFO, they cannot oppose it through administrative channels; however, this does not
limit the civil or criminal actions that they are entitled to exercise.
On the other hand, we consider that this precedent adds requirements to the procedure to
modify the name and code of the mining right in the IGAFOM, since, as of this precedent,
it is mandatory to notify the mining owner of the transfer concession and his consent by
showing the contracts or authorizations signed with the informal miner. For us, this new
requirement may represent a hindrance for the mining formalization process, since the
main obstacle to complete the formalization is to obtain the concession transfer or
exploitation contracts.
