Este trabalho busca verificar se a aplicação da doutrina do comity pode ser uma forma de obtenção de uma solução mais justa nas questões envolvendo a proteção internacional das obras de arte. Para isso, é necessária a investigação de uma pergunta anterior e secundária: qual o significado que é atribuído à doutrina do comity pelos operadores de direito? Para se conseguir responder estas questões, será apresentada a evolução histórica da doutrina do comity, desde o seu nascimento com a Escola Holandesa até os dias atuais. Depois de se obter um entendimento sobre essa doutrina, serão expostos alguns casos envolvendo a restituição de obras de arte, nos quais houve a ponderação em relação à aplicação do comity na solução dos conflitos. / This work aims to verify whether the application of the doctrine of comity may be a instrument to get a fairer solution on issues involving the international protection of works of art. Therefore, it is necessary to investigate a previous question: what meaning is assigned to the doctrine of comity by the operators of law? To be able to answer these questions, will be seen the historical evolution of the doctrine of comity, from the beginning, with the Dutch school, until today. After obtaining an understanding of this doctrine, will be exposed some cases involving the restitution of works of art in which there was a consideration about the application of comity in the solution of this conflicts.
