Esse tipo de crime, já conhecido nos séculos precedentes, ganhou novas características nas últimas décadas, pois a globalização imprimiu características inéditas na forma de estruturação e ação das organizações criminosas. A presente pesquisa busca retratar o fenômeno criminoso em sua forma organizada, com o objetivo de, por meio de um levantamento-diagnóstico, identificar o crime organizado mundialmente, para, então, analisar sua dimensão e os instrumentos de controle no Brasil. O objeto deste estudo é ainda recente demanda integração com o sistema penal brasileiro, o que é ainda um desafio. Esta pesquisa está estruturada em três capítulos. O primeiro tem o propósito de caracterizar o crime organizado como fenômeno dos Estados, multifacetado e com características específicas. No segundo capítulo, apresentam-se as abordagens doutrinárias e técnico-jurídicas do crime organizado e o sistema brasileiro de combate a esse fenômeno. No capítulo final, apontam-se elementos e contribuições para uma Política Criminal de melhor controle estatal do crime organizado. Trata-se de um esforço de confrontar o processo de organização da atividade criminosa e as deficiências dos mecanismos de controle, propondo melhorias, em perspectiva sistêmica (multidisciplinar e articulada), mediante a integração dos entes estatais e, no âmbito penal e processual penal, para melhorar a eficácia de controle e combate nessa realidade criminosa. / The crime is an expression of the societies and, currently, the organized crime is a worldwide phenomenon. This sort of crime, already known in previous centuries, incorporated new characteristics on the last decades, because the globalization inflicted inedited characteristics in the structure and action of the criminal organizations. The present research pursuits delineate the criminal phenomenon in its organized way, with the purpose of, throughout a diagnosis, identify the organized crime worldwide, so, analyze its dimension and the control instruments in Brazil. The subject of the study is recent, demands integration with the Brazilian penal system, which is still a challenge. This research is structured in three chapters. The first has the scope of feature the organized crime as a phenomenon of the States, multifaceted and with specific characteristics. On the second chapter, are presented doctrinaire and legal approaches of the organized crime and the Brazilian system to fight against this phenomenon. On the final chapter, are pointed out elements and contributions to a Criminal Policy in order to a better state control of organized crime. It is an effort of confront the process of organization of the criminal activity and the deficiencies of the control mechanisms, offering improvements, in systemic perspective (multidisciplinary and articulated), by the integration of the state assets and, on the penal area, to increase the efficiency of control and engagement of this criminal reality.
