Previous issue date: 2013-10-11 / Under the interdisciplinary perspective between Social Representations and Law, this work tries to clarify the process that involves a judicial decision. This way, it addresses the concept of Social Representations, how they are built from the concept of Collective Representations, the individual-group relation and the linguistic processes intricate in the representation process. It is shown, under the perspective of legal doctrine, the tools and elements linked to the legal hermeneutics from which the jurist relies for its decision to establish the view and understanding of social life. In this direction, the theoretical common sense, its concept and elements that involve the legal knowledge in this light are approached / Sob a perspectiva interdisciplinar entre Representações Sociais e Direito, o trabalho busca elucidar os processos que envolvem a decisão judicial. Nesse sentido, aborda o conceito de Representações Sociais, sua construção a partir do conceito de Representações Coletivas, a relação indivíduo-grupo e os processos linguísticos intrincados no processo de representar. Apresenta, sob a perspectiva da dogmática jurídica, as ferramentas e elementos ligados à hermenêutica jurídica de que se guia o jurista em suas decisões para estabelecer a leitura e compreensão da vida social. Aborda-se, nesse sentido, o senso comum teórico, seu conceito e elementos que envolvem o conhecimento jurídico sob essa perspectiva
