Previous issue date: 2007-08-13 / The work inserts the analysis of the powers entrusted of making the most important juridical document of modern society, the constitution of the state, but it also demonstrates the most existing different types of norms resultant of each one of these powers known as originary and derived. In order to show the limits imposed by the first to the second of these mentioned powers, the work broaches the consequences of the establishment of the constitutional law on the top of the normative scale. However, because of the imposition of these limits, means of controlling, in order to accomplish the will of the constitution necessarily arise and, in view of this, comes to know who should play the part of guardian of the constitution, but, specially how it have been played. In this context, it shows the growing power of those who have to play this role, playing it aside of a democratic principles. After that, there is an analysis throughout the history of the Brazilian Supreme Court. / O trabalho insere a analise dos poderes encarregados de fazerem o mais importante documento jurídico da sociedade moderna, a constituição do estado, mas ele também demonstra os mais diferentes tipos de normas resultantes de cada um desses poderes conhecidos como originário e derivado. No intuito de demonstrar os limites impostos pelo primeiro ao segundo desses poderes mencionados, o trabalho aborda as conseqüências do estabelecimento da lei constitucional no topo da escala normativa. Contudo, por causa da imposição de tais limites surgem necessariamente meios de controle para cumprir a vontade constitucional e, em vista disso, se vem, a saber, quem deve fazer o papel de guardião da constituição, mas, especialmente, como tem sido desempenhado tal papel. Nesse contexto é ressaltado o poder crescente desses guardiões, atuando fora dos princípios da teoria democrática. Há por fim, uma análise feita através da história do Supremo Tribunal Federal brasileiro.
