Gyventojų užimtumo teisiniai santykiai: subjektai ir turinys / Legal relations of the employment of the population: subjects and content

Valstybei vykdant užimtumo politiką, skatinant įvairiomis priemonėmis užimtumą, susiklosto visuomeniniai santykiai (ekonominių, socialinių), kurių dauguma įgyja teisinių santykių formą. Šie užimtumo teisiniai santykiai apibrėžiami kaip sistema teisinių, ekonominių, socialinių ir organizacinių priemonių, kurias teikia valstybės, savivaldybių arba kitos įmonės, įstaigos, organizacijos, siekdamos užimtumo, padedančios sudaryti darbo sutartį. Šiame darbe apžvelgta Lietuvos užimtumo teisinių santykių reglamentavimo raida, pabrėžiant juos įtakojančius tarptautinius teisinius pagrindus. Trumpai apžvelgtos užimtumo srityje reikšmingos TDO konvencijos, nurodant Lietuvos Respublikos teisės aktus, į kuriuos perkeltos šių Konvencijų nuostatos. Apžvelgta ES užimtumo strategija ir išnagrinėta jos įtaka Lietuvos užimtumo politikos formavimo kryptims bei užimtumo teisinių santykių reglamentavimui. / Public relations (economic, social) arise due to state’s policy and enhancement of employment, the majority of which gain the form of legal relations. These legal relations of employment are defined as the system of legal, economic, social and organizational means, which are provided by state, local administration or other institutions, companies, organizations by seeking bigger employment, helping to conclude work contract.
The regulation development of legal relations of employment in Lithuania is discussed in this thesis, putting more emphasis on international legal grounds that influence them. ILO conventions, which are meaningful to employment sphere, are briefly reviewed by noting legal acts of Republic of Lithuania where statute of Conventions is removed. EU employment strategy is reviewed and its impact on Lithuania’s employment policy for formed directions as well as regulation of legal relations of employment is analyzed.
Conception of legal relations of employment is defined in a wider and narrower sense. Subjects of legal relations of employment are noted, their legal personality is defined. Competence of subjects of ruling system of employment is placed.
Content of legal relations of employment in Lithuania is analyzed referring to new law of Employment support and substatutory legal acts related to it.
