Previous issue date: 2012-02-24 / O presente estudo busca analisar o contexto de desvanescimento das instituições
estatais, da democracia representativa e da própria sociedade civil nem contexto de
crise da civilização ocidental. Tal desvanescimento vem se dando ao longo dos
últimos séculos, notadamente a partir do século XVI, com o surgimento das
primeiras formas de capitalismo. A relação do Estado com o Direito também é
apresentada, constatando-se que a razão para a criação daquele foi a necessidade
de o mesmo realizar uma espécie de controle metabólico por sobre a própria
capacidade expansiva do capital. Num contexto de crise da civilização ocidental,
analisa-se a crise financeira mundial de 2008, em que se deu o colapso da
economia norte-americana e cujo salvamento, realizado com o dinheiro do povo, foi
a única maneira de salvar a própria sociedade norte-americana do calapso causado
pela onde de inflação que acabaria ocorrendo acaso Wall Street não conseguisse se
fortalecer. A crise norte-americana, portanto, representou a chamada crise das
hipotecas subprime, estimuladas pelo governo americano para reduzir os efeitos
negativos ocasionados para a economia pela “bolha das .com”, a crise tecnológico
que assolou os Estados Unidos e o Mundo no início do século XXI. Constatou-se
que no decorrer da crise financeira mundial de 2008 a humanidade ficou perplexa
com os acontecimentos, deixando de demonstrar quaisquer manifestações de
indignação contra a ganância demonstrada pelo capitalismo financeiro de Wall
Street, marcado pelos chamados laboratórios frankstenianos, em que toda a sorte
de derivativos tóxicos (de alto risco) eram criados com a finalidade de obtenção de
lucros de curto prazo, sem a mínima preocupação com a real situação financeira dos
prestamistas, vítimas do consumismo ditado pela ideologia hegemônica capitalista.
Os primeiros sintomas da reconstrução do sujeito e observância do verdadeiro
significado de pessoa humana pôde ser observado com as manifestações de caráter
global iniciadas pelo movimento self government denominado Occupy Wall Street,
cuja ideologia vem se mostrando contra-hegemônica e muitas das vezes libertadora.
A partir desta mudança paradigmática, passou-se a analisar qual forma sóciopolítica
seria capaz de sanar os maiores antagonismos da modernidade, quando
então foi constatado que somente a iniciação de um processo libertado do Ser
Humano e do Outro, que é de sua responsabilidade, levando-se em consideração
uma revisão do princípio da dignidade da pessoa humana na perspectiva da ética da
alteridade e da responsabilidade. / This study assesses the context of fading of the state institutions of representative
democracy and civil society itself or the context of the crisis of Western civilization.
Such fading has proceeded over the past centuries, especially from the sixteenth
century with the emergence of the earliest forms of capitalism. The relationship with

about the real financial situation of the lenders, victims of consumerism dictated by
the hegemonic ideology of capitalism. The first symptoms of the reconstruction of the
subject and observing the true meaning of human being could be observed with the
manifestations of global character self-initiated movement Occupy government called
Wall Street, whose ideology is proving counter-hegemonic and often liberating. From
this paradigm shift, went to examine the socio-political order which would be able to
solve the major contradictions of modernity, when it was found that only the initiation
