Previous issue date: 2010-03-19 / This work operates from the perspective of the phenomenon of globalization and its
consequences eventually require a new redefinition of citizenship, a broader definition,
compared to the impact that new paradigms in political, economic, social and cultural
development have revealed to individuals, to state, and international actors finally.
Under this approach, we have a Brazilian Constitution, promulgated in 1988 which deals
with citizenship. The goal is to investigate whether the concept of citizenship addressed
in the text accompanying this new perspective of the term, seen under the eyes of
globalization. If citizenship brought to light by the 1988 Charter, has evolved in these 21
years of enactment as to meet the compliance of this new citizenship, whose
parameters are still uncertain and complex, but to whose problems are present. So, after
a previous approach the themes of constitutionalism, human rights and citizenship, is
entering the 1988 Constitution in its entirety, in our conception authoritative theoretically
correspond to the definition of citizenship according to our legal system. And how to use
the theoretical framework neoconstitutionalism, whose design is based on lessons from
Luís Roberto Barroso, Daniel Sarmento and Flavia Piovesan, in others, presented as a
phenomenon set to the theory of constitutional law and understood by us as a base to
expand the role of Constitution in the ideals of citizenship. The following will be prepared
an analysis of globalization and its repercussions in the sphere of rights. The
methodology we used for consulting work, case law and legislation related to the topic.
The conclusion will ultimately determine whether citizenship in our Constitution walked
sufficiently to follow the complexities of citizenship in global terms. / Este trabalho opera sob a perspectiva de que o fenômeno da globalização e suas
conseqüências acabam por exigir uma nova redefinição de cidadania; uma definição
mais ampla, frente às repercussões que novos paradigmas na área política, econômica,
social e cultural têm revelado aos indivíduos, ao Estado, aos atores internacionais
enfim. Sob este enfoque, temos uma Constituição brasileira, promulgada em 1988 que
trata da cidadania. O objetivo é investigar se a concepção de cidadania tratada no texto
constitucional acompanhou essa nova perspectiva desse termo, pensada sob os
olhares da globalização. Se a cidadania trazida a lume pela Carta de 1988, evoluiu
nestes 21 anos de promulgação a ponto de responder às conformidades dessa nova
cidadania, cujos parâmetros ainda são incertos e complexos; mas, de cujos problemas
se fazem presentes. Para tanto, após uma abordagem prévia dos temas do
constitucionalismo, dos direitos humanos e da cidadania, se adentrará à Constituição
de 1988, em seus elementos que, em nossa concepção abalizada teoricamente,
correspondem à delimitação de cidadania segundo nossa ordem jurídica. E como
marco teórico se utilizará o neoconstitucionalismo, cujo delineamento se assenta nas
lições de Luís Roberto Barroso, Daniel Sarmento e Flávia Piovesan, dentro outros,
apresentado como fenômeno ajustado à teoria do direito constitucional e por nós
entendido como base a se ampliar o papel da Constituição no ideário de cidadania. A
seguir, será elaborada uma análise da globalização e de sua repercussão na esfera dos
direitos. A metodologia utilizou-se de consulta a obras, jurisprudência e legislação
correlata ao tema. A conclusão terminará por definir se a cidadania em nossa
Constituição caminhou suficientemente a ponto acompanhar as complexidades de uma
cidadania em termos globais.
