Defesa: Curitiba, 2016 / Inclui referências : f. 154-160 / Resumo: A presente dissertação tem como desígnio ponderar sobre a proteção de dados pessoais a partir da concepção da privacidade como autodeterminação informativa, perquirindo sobre uma possível dimensão funcional da precitada disciplina jurídica da privacidade e da responsabilidade civil ao incremento da liberdade de cada pessoa na construção de sua esfera de personalidade, atentando para as premissas metodológicas do direito civil-constitucional e para as problematizações desinentes de uma teoria crítica do direito civil. Assim, o estudo propugna inicialmente uma leitura da privacidade no bojo da teoria geral dos direitos da personalidade, evidenciando com clareza o giro conceitual operado em tal campo e assumindo, por igual, a definição da privacidade como valor assentado normativamente no princípio da dignidade da pessoa humana, cuja tutela se dá por meio da cláusula geral inaugurada na Constituição Federal de 1988. No influxo de tais perspectivas, despontam reflexões sobre a configuração do dano na seara dos dados pessoais, tomando-se como ferramenta auxiliar de análise a teoria do fato jurídico para que se possa, em passo seguinte, descortinar a relevância da técnica de ponderação para a seleção dos interesses merecedores de tutela ante o choque de liberdades perceptível no campo da autodeterminação informativa, consubstanciada, a seu turno, pelo enlace da liberdade em sentido substancial e positivo e em conjunto com o espectro de prevenção expresso pela responsabilidade civil hodierna, além de discutir objetivamente a necessidade de desmonetarização do dano moral decorrente da violação de dados pessoais. PALAVRAS-CHAVE: privacidade; personalidade; autodeterminação informativa; liberdade; função; responsabilidade civil. / Abstract: This dissertation is to design ponder the protection of personal data from the conception of privacy and informational self-determination and to assert about a possible functional dimension of legal discipline of privacy and liability to increase the freedom of each person to build their personality sphere, noting the methodological assumptions of the civil and constitutional law and the problematizations of a critical theory of civil law. Thus, the study initially advocates a privacy reading in the midst of the general theory of personal rights, showing clearly the conceptual working operated in such a field and assuming the same, the definition of privacy as seated value normatively on the principle of human dignity human whose protection is through the general clause inaugurated in the Federal Constitution of 1988. The influx of these perspectives emerge reflections on the damage setting in the harvest of personal data, taking as analysis of auxiliary tool the theory of legal fact so that we can, in the next step, uncover the relevance weighting technique for selection of worthy interests of protection against shock perceived freedoms in the field of informational self-determination, based, in turn, by the linkage of freedom in substantial and positive direction and in conjunction with the spectrum of prevention expressed by today's civil liability, in addition to discussing objectively the need for debate of moral damages resulting from the breach of personal data.
