Defesa: Curitiba, 25/04/2017 / Inclui referências : f. 228-263 / Resumo: Nos últimos trinta anos, constata-se a consolidação de um discurso teóricoconstitucional no âmbito jurídico brasileiro que afirma a superação do positivismo jurídico como teoria do direito em razão da constitucionalização do fenômeno jurídico após II Guerra Mundial. Assim, o problema a ser investigado no presente estudo é o seguinte: "o positivismo jurídico encontra-se superado como teoria do direito no âmbito das democracias constitucionais contemporâneas?". A tese sustentada pelo discurso neoconstitucionalista afirma que a resposta a esta pergunta é afirmativa. Do ponto de vista metodológico, o presente o trabalho elege a tese neoconstitucionalista como proposição lógica central e a submete a testes críticos no intuito de averiguar se ela pode ser tomada como verdadeira ou se, ao contrário, deve ser tida como falsa. A hipótese assumida é a de que tal proposição deve ser considerada falsa, ou seja, de que as críticas feitas ao positivismo jurídico pelos neoconstitucionalistas não conduzem necessariamente à sua rejeição como teoria descritiva do funcionamento do fenômeno jurídico tal como ele se apresenta atualmente nas democracias constitucionais. Ao final, constata-se a falsidade da proposição que enuncia a tese neoconstitucionalista e a veracidade da hipótese assumida, verificando-se a atualidade da perspectiva juspositivista como empreendimento epistemológico capaz de fornecer uma descrição adequada do fenômeno jurídico tal como ele se apresenta nos Estados Constitucionais. Palavras-Chave: teoria do direito; neoconstitucionalismo; positivismo jurídico; póspositivismo; direito constitucional. / Abstract:In the last thirty years, there has been a consolidation of a theoretical-constitutional discourse in the brazilian legal system that affirms the overcoming of legal positivism as a theory of law due to the constitutionalisation of the juridical phenomenon after the II World War. Thus, the problem to be investigated in the present study is: "is legal positivism overtaken as a theory of law in the context of contemporary constitutional democracies?" The thesis supported by the neoconstitutionalist discourse affirms that the answer to this question is affirmative. From a methodological point of view, the present work chooses the neo-constitutionalist thesis as a central logical proposition and submits it to critical tests in order to ascertain if it can be taken as true or if, on the contrary, it should be considered as false. The hypothesis is that such a proposition should be considered false, that the criticisms made against legal positivism by neoconstitutionalists do not necessarily lead to its rejection as a descriptive theory of the functioning of the juridical phenomenon as it presently occurs in constitutional democracies. In the end, it was verified the falsity of the proposition that enunciates the neoconstitutionalist thesis and the veracity of the assumed hypothesis, being verified the actuality of the positivist perspective as epistemological enterprise able to provide an adequate description of the legal phenomenon as it presents itself in Constitutional States.
