Previous issue date: 2018-08-14 / The aim of this dissertation is to study the fundamental rights of religious freedom, artistic expression and the conflict in between them. The research begins with the studies of the definitions and relevance of religion and art, respectively, to analyze the Brazilian constitutional trajectory of these two rights and related international legislation. Therefore, the technique for conflict resolution is identified, as well as its deployment in the application on a concrete case. For this, the main focus is to identify whether, in Brazil, religion or the right of religious freedom has directly interfered with the right of artistic expression freedom from the perspective of the last mentioned regulation in the state sphere. The hypothesis raised by the research is affirmative and has been confirmed with its development. The research was developed through the analysis about the regulation of the freedom of artistic expression under the religious foundation in the Brazilian States. It is concluded that the regulations found, from August 2017 to May 2018, have similar texts and have in common the justification in moral and religious convictions, noting the influence of religion on freedom of creation. It was also found that the foundations used by the state deputies are, for the most part, unconstitutional, either for the matter addressed or for the competence to produce laws. The bibliographic methodology was used with a qualitative and descriptive approach.

Conflicts. / A presente dissertação tem por objeto o estudo dos direitos fundamentais de liberdade religiosa, de expressão artística e o conflito do seu exercício. A pesquisa inicia pelos estudos das definições e relevância, respectivamente, da religião e da arte, para, em seguida, investigar a trajetória constitucional brasileira desses dois direitos e a legislação internacional relacionada. Logo depois, é identificada a técnica para solução dos conflitos, assim como o seu desenvolvimento na aplicação de um caso concreto. O objetivo geral é analisar se, no Brasil, a religião ou direito à liberdade religiosa tem interferido diretamente no direito de liberdade de expressão artística sob a perspectiva da regulação desse último na esfera estadual. A hipótese levantada pela pesquisa é afirmativa e foi confirmada com o seu desenvolvimento. A investigação foi desenvolvida através da análise acerca da regulação da liberdade de expressão artística sob o fundamento religioso nos estados brasileiros. Conclui-se que a regulamentação encontrada, no período de agosto de 2017 a maio de 2018, possui textos semelhantes que têm em comum a justificativa em convicções morais e religiosas, constatando a influência da religião sobre a liberdade de criação. Constatou-se também que os fundamentos utilizados pelos deputados estaduais são, em sua maioria, inconstitucionais, seja pela matéria abordada ou pela competência para produção de leis. A metodologia utilizada é do tipo bibliográfica, com abordagem qualitativa e descritiva.
