Previous issue date: 2018-08-14 / According to data from the National Supplementary Health Agency, since September 2015, there has been a downturn in the market for medical and hospital care. In addition to the economic crisis and, consequently, unemployment, other factors contribute to the decrease in the number of health plan users, such as the increase in health insurance monthly payments, resulting from the increase in court decisions that oblige health care providers to services without contractual coverage. In view of this Brazilian reality, this dissertation aims to propose a model of Technical Support and Mediation Nucleus in the Court of Justice of the State of Ceara aimed at the "judicialization" of supplementary health. To do so, the first chapter outlined the legal-constitutional regime of the right to health and the structural organization of the Unified Health System (UHS) and the supplementary health subsystem, so that, in the second chapter, one could discuss, in concrete terms, on the problems related to judicial activism and the judicialization of supplementary health in the State of Ceara. In a survey conducted on the website of the Court of Justice of the State of Ceara, 83 decisions were analyzed in Civil Appeals in 2017. From these decisions it was possible to verify the supplementary health issues most discussed in the scope of the Judiciary of Ceara and how the magistrates decided these demands, in particular, if there is the practice of judicial activism in the aforementioned Court. In the third chapter, the experiences of some Courts of Justice of the States with the Technical Support Centers already existing in relation to the UHS, the experience of the Court of Justice of Sao Paulo with the Nucleus of Technical Support and Mediation focused on health supplementary and similar bodies, which adopt judicial and extrajudicial mediation in the resolution of conflicts between health care providers and beneficiaries. The methodology used was documentary-bibliographic, with a qualitative, quantitative, descriptive and exploratory approach. It is concluded that the best way to implement the Nucleus of Technical Support and Mediation in Supplementary Health in the State of Ceara would be to take advantage of the already existing Nucleus in public health, implementing the preliminary injunction, through the participation in the Nucleus of operators of health, of the Public Defender of the State of Ceara and of mediators registered by the Court.

Mediation. / Segundo dados da Agência Nacional de Saúde Suplementar, desde setembro de 2015, está ocorrendo uma retração no mercado de assistência médica e hospitalar. Além da crise econômica e, consequentemente, do desemprego, outros fatores contribuem para a queda do número de usuários de planos de saúde, como, o aumento das mensalidades dos planos de saúde, resultante do crescimento de decisões judiciais que obrigam as operadoras de saúde à prestação de serviços sem cobertura contratual. Diante desta realidade brasileira, a presente dissertação tem como objetivo geral propor um modelo de Núcleo de Apoio Técnico e de Mediação no Tribunal de Justiça do Estado do Ceará voltado à ¿judicialização¿ da saúde suplementar. Para tanto, no primeiro capítulo, delineou-se o regime jurídico-constitucional do direito à saúde e a organização estrutural do Sistema Único de Saúde (SUS) e do subsistema de saúde suplementar, para que, no segundo capítulo, se pudesse discutir, em termos concretos, sobre os problemas relacionados ao ativismo judicial e à judicialização da saúde suplementar no Estado do Ceará. Em pesquisa realizada no sítio eletrônico do Tribunal de Justiça do Estado do Ceará, foram analisadas 83 decisões em Apelações Cíveis, no ano de 2017. A partir dessas decisões foi possível verificar os assuntos em saúde suplementar mais discutidos no âmbito do Poder Judiciário cearense e como os magistrados decidiram essas demandas, notadamente, se há a prática de ativismo judicial no aludido Tribunal. No terceiro capítulo, analisaram-se as experiências de alguns Tribunais de Justiça Estaduais com os Núcleos de Apoio Técnico já existentes em relação ao SUS, bem como as experiências do Tribunal de Justiça de São Paulo com o Núcleo de Apoio Técnico e de Mediação voltado à saúde suplementar e de órgãos semelhantes, que adotam a mediação, judicial e extrajudicial, na resolução dos conflitos entre operadoras de saúde e beneficiários. A metodologia utilizada foi de tipo documental-bibliográfico, com pesquisa de abordagem qualitativa, quantitativa, descritiva e exploratória. Conclui-se que a melhor forma de implantar o Núcleo de Apoio Técnico e de Mediação em saúde suplementar no Estado do Ceará seria aproveitando o Núcleo já existente em saúde pública, implantando a mediação liminar, por meio da participação, no Núcleo, de operadoras de saúde, da Defensoria Pública do Estado Ceará e de mediadores cadastrados pelo Tribunal de Justiça do Estado do Ceará.
