Previous issue date: 2009-11-06 / The study regarding popular action refers to the politics discourse for the efficacy of the institute, through a bibliographical research, with qualitative meaning, exploratory and descriptive purpose. Analyzes the semantics conception of the popular action as fundamental guarantee, its nature, distinction and systematic in the constitutional juridical order, gathering together the formal elements which set its content through the Brazilian constitutions and accentuates the contemporary juridical and political thinking into three different phases: the Liberal Monarchy, the Republic and the Social Democracy. Promotes a discussion about the efficacy of this guarantee on its theorical treatment of the hegemonies e counter hegemonies discourse. It also evidences the implementation of the jurisdiction on the popular demand, emphasizing the elements and conditions of the action, allied to the jurisprudential construction of the institute focused on the model of the Brazilian experience: the laceration to the public patrimony and the illegality of the administrative act to the constitutional popular action. Refers as well about the manifestation of the democratic principle assembled to a
historical and social reflection of the Brazilian constitutional order, founded on the popular guarantee as an instrument of the participative democracy on the civil society perspective and the popular character which concludes the legitimacy of the constitutional popular action.

Social Efficacy. / O estudo sobre a ação popular constitucional trata do discurso político para a eficácia do instituto, a partir de uma pesquisa do tipo bibliográfica, de natureza qualitativa, com fins exploratórios e descritivos. Analisa a concepção semântica da ação popular enquanto garantia fundamental, sua natureza, distinção e sistemática na ordem jurídica constituional. Relaciona a evolução do pensamento jurídico brasileiro sobre a ação popular constitucional, reunindo os dispositivos formais que demarcam o seu conteúdo ao longo das Constituições brasileiras e enfatiza o pensamento jurídico-político contemporâneo em três fases: a monarquia liberal, a republicana e a democrática social em face da ação popular constitucional brasileira. Evidencia a tutela da prestação jurisdicional no âmbito da demanda popular, com destaque para os elementos e as condições da ação, associada à construção jurisprudencial do instituto em virtude do modelo que se firma na experiência brasileira: da lesividade ao patrimônio público e ilegalidade do ato administrativo para a ação popular constitucional. Promove a
discussão sobre a eficácia em cotejamento teórico sobre o discurso de hegemonias e contrahegemonias em torno da garantia. Evidencia-se com a eficácia do instituto popular a manifestação do princípio democrático em conjunto a uma reflexão histórico-social sob a ordem constitucional brasileira, com fundamento na garantia popular enquanto instrumento da democracia participativa na perspectiva da sociedade civil e o caráter político que encerra a legitimidade da ação popular constitucional.
