Previous issue date: 2012-05-08 / The present work investigates the possibility of implementing the mediation technic in penitentiaries of Ceara. Aiming at reducing the internal conflicts of the prison system and collaborate with the resocialization of the convicted one. Mediation is an alternative technic, extrajudicial and consensual of conflict solution in which the litigants have the power of management and decision, counting on the help of a mediator. Mediation basis is the communication. Hence, it was taken structure and research about the constitutional principles that emphasizes the dignity of the human being, considered in this study as a super principle. The disrespect to this principle was noticed when it was consigned the situation of the prison system in Brazil, specifically, in Ceara State. It was built an historical and bibliographical parallelism of authors who registered the origins of the prisons and current authors, emphasizing writers from Ceara. It was also held the analysis of the mediation institute, as a method non adversarial in the resolution of conflicts, when it was detached the results of school, community and penal mediation, experience obtained in Ceara State. The particularities of the prison system, however, present obstacles to the mediation different from other environments where it was already applied. Absence of trust among the prisoners, danger, psychological, moral and physical aggression, besides the disbelief in the system and low self-steam among the prisoners were observed. It was aligned practice and theory and it was presented successful experiences of the mediation application in the prison environment happened in Mexico. Enclosed documents witnessed, though the needy of specific criteria to be adopted to the prison system, to be possible the application. Based on the analysis carried out, it was concluded that mediation can be applied as a mean of reducing conflicts in the penitentiaries of Ceara State, aiming to the reduction of internal violence and construction of social peace.
Key-words: mediation, prison system, human dignity, resocialization, social peace. / O presente trabalho perscruta a possibilidade de implantar a técnica da mediação nos presídios do Estado do Ceará, com o objetivo de reduzir os conflitos internos ao sistema prisional e colaborar com a ressocialização do apenado. A mediação é técnica alternativa, extrajudicial e consensual de solução de conflitos, na qual as partes possuem a gerência e o poder de decisão, contando com o auxílio de um mediador. A base da mediação é a comunicação. Para tanto, buscou-se estruturar a pesquisa sobre os princípios constitucionais que enfatizam a dignidade da pessoa humana, considerado neste estudo como sobreprincípio. O desrespeito a este princípio foi percebido ao analisar a situação do sistema carcerário do Brasil, em especial, do Estado do Ceará. Foi construído um paralelo histórico bibliográfico de autores que registraram o surgimento das prisões e atuais escritores, com ênfase em autores cearenses. Também foi realizada análise do instrumento da mediação, como método não adversarial na resolução de conflitos, quando foram destacados os resultados da mediação escolar, comunitária e penal, experiências obtidas no Estado do Ceará. As particularidades do ambiente prisional, contudo, apresentaram óbices à mediação diferentes de outros ambientes onde já se aplica essa técnica. Desconfiança entre os internos, periculosidade, agressividade psicológica, moral e física, além da descrença no sistema e baixa estima entre os apenados, foram observados. Alinhou-se a teoria à prática e foram apresentadas experiências exitosas da aplicação da mediação no ambiente prisional realizado no México. Documentos apensados testemunharam, a despeito da necessidade de critérios específicos a serem adotados para o ambiente prisional, ser possível a implantação. A partir das análises realizadas, conclui-se que a mediação pode ser aplicada como meio de redução de conflitos no interior dos presídios do Estado do Ceará, com vistas à redução da violência interna e à construção da paz social.
