Previous issue date: 2012-08-29 / This dissertation is scoped to the study of civil judicial actions through which slaves They used the Imperial Court aiming to achieve freedom in Ceará during the course of the Second Empire. From the reconstruction of these stories litigation, we analyze the main tension in the slave, taking into account the cyclical changes such as the end of the slave trade in 1850 and emancipationist laws of 1871 and 1885. Based on bibliographic references, and especially documentary by the collection contained in the Public Archives of the State of Ceará, is intended to verify that, at different times, highlights the participation of slaves as agents of the struggle for emancipation. The aim is also to analyze the participation of alumni and magistrates abolitionists, which turned the courts into a privileged arena for the expression of libertarian demands and contributed to the change in the assumptions of legal discourse that they held.

Court of Appeal of Ceará. / Esta dissertação tem como escopo o estudo das ações judiciais cíveis por meio das quais os escravos acionavam a Justiça imperial almejando conseguir a liberdade no Ceará, durante o transcurso do Segundo Reinado. A partir da reconstrução das histórias destas disputas judiciais, analisam-se as principais tensões nas relações escravistas, levando-se em conta as modificações conjunturais, como o fim do tráfico de escravos em 1850 e as leis emancipacionistas de 1871 e 1885. Baseado em referencial bibliográfico e, principalmente, documental, por meio do acervo constante do Arquivo Público do Estado do Ceará, pretendese verificar que, em diferentes momentos, evidencia-se a participação dos escravos como agentes do processo de luta pela emancipação. Pretende-se, ainda, analisar a participação dos bacharéis e magistrados abolicionistas, os quais transformaram os tribunais numa arena privilegiada de expressão de demandas libertárias e contribuíram para a alteração dos pressupostos do discurso jurídico que o sustentavam.
