Previous issue date: 2015-08-24 / The hate speech as possible limitation to free speech is current discussion, but little addressed by doctrine and Brazilian law, although, in alien law, there are various manifestations on the subject. The main point of this work is about hate speech setting, its several forms of expression and the means used to propagate it, seeking to delimit the boundary between the extremist speech and freedom of speech and analyzing the possibility of granting constitutional protection to hate speech under the guise of free speech. The overall objective is to address the problem of hate speech in the face of the fundamental right of free speech. The specific objectives are: 1) define the degree of limitation that free speech admits; 2) address the limits that already exist in Brazilian Law; 3) conceptualize hate speech, establishing its settings regarding the right to freely express your opinions, as well as the treatment given to it
in foreign courts; 4) assess whether it should be given constitutional protection to hate speech, under the mantle of the fundamental right of free speech. The paper's methodology is bibliographic, researching in the Brazilian and international doctrine, and documentary, with cases analysis and national and international legislation. Regarding the results, the methodology is pure, since it aims to expand knowledge and to encourage reflection, without, however, crave immediate change of reality. The nature of the methodology is quantitative, since it explores the understanding of the subject by a subjective perspective, not quantifiable. As for the purpose, the methodology is descriptive and exploratory, because it interprets facts, rules and cases on the subject, in order to improve the ideas, challenging future research. First, the most used techniques to solve conflicts between principles is studied, considering that
these contain the structure of fundamental rights, adopting as a theoretical reference the principles theory of Robert Alexy. Following, it is sought to analyze the treatment given to freedom of speech in international and national law, to then study specifically the hate speech phenomenon, conceptualizing it and addressing its offensive potential and its legislative regulation here and elsewhere. At the end, it is said that this phenomenon is protected within the right to free speech, seeking to establish appropriate ways to address the problem of hate speech and make it compatible with freedom of speech. Fundamental rights. / A temática do hate speech como possível limitador da liberdade de expressão é atual e, tanto quanto, pouco abordada na doutrina e jurisprudência brasileiras, embora no direito alienígena abundem manifestações diversas sobre o tema. O ponto nodal do trabalho diz respeito à configuração do hate speech, suas diversas formas de expressão e dos meios utilizados para propagá-lo, buscando-se delimitar a fronteira que separa o discurso extremista da livre manifestação de opinião e analisando-se a possibilidade de conferir proteção constitucional ao hate speech sob o manto da liberdade de expressão. O objetivo geral do trabalho é abordar a problemática do hate speech, em face do direito fundamental à liberdade de expressão. Os objetivos específicos são: 1) definir o grau de limitação que a liberdade de expressão admite; 2) abordar os limites já previstos no Ordenamento brasileiro; 3) conceituar o hate speech, estabelecendo sua configuração em face do direito à livre manifestação de opinião, bem como o tratamento que lhe é dado nas Cortes estrangeiras; 4) aferir se deve ser conferida proteção constitucional ao hate speech, sob o manto do direito fundamental à liberdade de expressão. Quanto ao tipo, a metodologia do trabalho é bibliográfica, com consulta à doutrina brasileira e internacional, e documental, com análise de jurisprudência e legislação nacionais e
estrangeiras. Quanto à utilização dos resultados, a metodologia é pura, pois visa à ampliação do conhecimento e estímulo à reflexão, sem, contudo, almejar imediata modificação da realidade. A natureza da metodologia é qualitativa, uma vez que explora a compreensão do tema por uma perspectiva subjetiva, não quantificável. Quanto aos fins, a metodologia é descritiva e exploratória, pois interpreta fatos, normas e julgados relativos ao tema, visando ao aprimoramento das ideias e desafiando pesquisas vindouras. Primeiramente, são estudadas as técnicas mais empregadas para resolver o conflito entre princípios, considerando que estes encerram a estrutura dos direitos fundamentais, adotando-se como referencial teórico a teoria dos princípios de Robert Alexy. A seguir, busca-se analisar o tratamento conferido à liberdade de expressão no direito internacional e interno, para em seguida estudar-se especificamente o fenômeno do hate speech, conceituando-o e abordando seu potencial ofensivo e sua regulação legislativa e jurisprudencial aqui e alhures. Ao final, conclui-se pela proteção de tal fenômeno
dentro do direito à liberdade de expressão, buscando-se estabelecer formas adequadas para solucionar a problemática do discurso odioso e compatibilizá-lo com a liberdade de opinião. Palavras-chave: Liberdade de expressão. Hate speech. Direitos fundamentais.
