Previous issue date: 2012-10-22 / Coordenação de Aperfeiçoamento de Pessoal de Nível Superior / This thesis grasps children and adolescents reality under residential care protection, checking whether there are alternatives to this protective measure. The aim is also, to know how these children and adolescents understand the care they need. Although, besides the theoretical research around the themes - public policies for family law, the children and adolescents right to a family companionship in institutional sheltering and children and adolescents family care - field research was carried out, whose individuals were eight children and adolescents under institutional care in Rio das Pedras (SP) and Piracicaba (SP). During the group play interviews, it was possible to learn about these individuals reality, through the voice of key stakeholders in the rights of family life: the proper children and adolescents. Despite advances in legislation related to family law, the reality studied, there is no alternative to residential care, when is necessary children and adolescents removal from their original family. In this research the individuals reinforce how important it is and how much they miss their family life, for being in residential care institutions. Regarding care, children reinforce the importance of being satisfied, mainly in their nutritional needs. Adolescents comprehend access to work as a mean of providing the necessary care to a family. They do not think of basic material conditions of greater relevance, but emphasize the need for a family reference. It comes through, however, that there´s a long path to be course for children and adolescents right to a family companionship in institutional sheltering. / Na presente tese, apreende-se a realidade de crianças e adolescentes em medida de proteção de acolhimento institucional, verificando se existem ou não alternativas a essa medida protetiva. Pretende-se, ainda, conhecer como essas crianças e adolescentes entendem os cuidados que lhes são necessários. Para isso, além da pesquisa teórica em torno dos temas - políticas públicas voltadas à família, direito da criança e do adolescente à convivência familiar, e cuidados da família para com as crianças e os adolescentes - foi realizada pesquisa de campo, cujos sujeitos foram oito crianças e adolescentes em medida de acolhimento institucional nos Municípios de Rio das Pedras (SP) e Piracicaba (SP). Durante as entrevistas grupais lúdicas, foi possível conhecer a realidade desses sujeitos, por meio da voz dos principais interessados no direito à convivência familiar: as crianças e os adolescentes. Apesar dos avanços na legislação relacionados ao direito à convivência familiar, na realidade pesquisada, não há alternativas ao acolhimento institucional, quando se faz necessário o afastamento de crianças e adolescentes de sua família de origem. Os sujeitos da pesquisa reforçam quão importante é e quanto sentem falta da convivência familiar, por estarem em acolhimento institucional. Em relação aos cuidados, as crianças reforçam a importância de serem supridas, principalmente, em suas necessidades de alimentação. Os adolescentes veem o acesso ao trabalho como meio de oferecer os cuidados necessários a uma família. Não pensam nas condições materiais básicas como de relevância maior, mas sim enfatizam a necessidade de ter uma referência familiar. Verifica-se, contudo, que ainda há muito a avançar para a efetivação do direito da criança e do adolescente à convivência familiar
