Previous issue date: 2016-05-13 / Coordenação de Aperfeiçoamento de Pessoal de Nível Superior / The objective of the research, giving rise to this effort, seeks to address the problem of democracy in the age of biopower and of biopolitics and questions about making a living. There are at work, the issue of totalitarian behavior in the democratic process as a way to govern. The research method used by research takes the theoretical writings of the philosophers Hannah Arendt, Michel Foucault and Giorgio Agamben. I turn to other thinkers and other propositions that contribute to the importance of ethics and justice in public policy within, strengthening the idea of a humanistic policy as contributing to an orderly society. In current times, the power and its effect supersedes any and all interest when people move from their countries in search of legal and political security in the pursuit of biopolitics. Analyzes are rescues who warn us about this issues, aiming to avoid the trivialization of evil and power, preventing the dimensions of state power within a community, ends up preventing satisfactory social directions when it should be at the service of the order and protection, allowing the constitutional effectiveness. A change in the paradigm of language between the existing power relations and policy make live and let die is essential point along the social spheres, enabling the effectiveness of justice and biopolitics / O objetivo da pesquisa que deu origem a este trabalho é tratar o impasse da Democracia na era do biopoder e da biopolítica e questões sobre o fazer viver. É abordada no trabalho a questão de condutas totalitárias no processo democrático, na forma de governar. O método de investigação utilizado toma por base os textos teóricos dos filósofos Hannah Arendt, Michel Foucault e Giorgio Agamben. Recorro a outros pensadores e outras proposições que reforçam a importância da ética e da justiça no seio político público, fortalecendo a ideia de uma política humanista como contribuinte de uma sociedade ordenada. Nos tempos atuais, o poder e seus efeitos sobrepõem-se a todo e qualquer valor, quando populações deslocam-se de seus países em busca de segurança jurídica e política, no que chamamos de biopolítica. Resgatam-se análises que nos alertam quanto a essas questões, com o intuito de impedir a banalização do mal e do poder, evitando que as dimensões do poder estatal dentro de uma comunidade acabem por frustrar direcionamentos sociais satisfatórios, quando deveriam estar a serviço da ordem e da proteção, possibilitando a efetividade constitucional. Uma mudança no paradigma da linguagem existente entre as relações de poder e política do fazer viver e deixar morrer é ponto essencial junto às esferas sociais, facultando a efetividade da justiça e da biopolítica
