Previous issue date: 2017-02-15 / The present study consists of the analysis of the contradictory in the civil process. It is intended to demonstrate the evolution of the institute and its strong presence in the current Code of Civil Procedure.
It proposes a concept of contradictory and that the institute has a nucleus, which is the participation and the guarantee of influencing the judicial pronouncement. In importance, the guarantee principle has distinctions with ample defense, isonomy and cooperation. And it is in this context that, preserving the separation of powers, is that the process reaches other limits, expansive, out of the records. And in the need of interpretation of the legal matter, legality has another meaning / O presente estudo consiste na análise do contraditório no processo civil. Pretende-se demonstrar a evolução do instituto e sua forte presença no atual Código de Processo Civil.
Propõe um conceito do contraditório e que o instituto tem um núcleo, que é a participação e a garantia de influenciar o pronunciamento judicial. Na importância, o princípio-garantia tem distinções com a ampla defesa, a isonomia e a cooperação. E é neste contexto que, preservada a separação de poderes, é que o processo alcança outros limites, expansivos, para fora dos autos. E na necessidade de interpretação da matéria jurídica, a legalidade obtém outro sentido
