The Application of Decision Theory and Dynamic Programming to Adaptive Control Systems

It is generally assumed that the implementation of adaptive control requires a precise identification of plant parameters. In the case of a system with varying parameters, the identification problem gets very involved, as speed of identification and accuracy are contradictory requirements. In this thesis it has been shown that using a feedback policy, the optimal controller is relatively· insensitive to changes in plant parameters as long as these lie within some specified ranges. It is, therefore, concluded that, with such an arrangement, adaptive control can be implemented if one has only the knowledge of the ranges within which the parameters of the plant lie. Thus identification can be carried on more rapidly, as stringent accuracy is no longer necessary. / Thesis / Master of Engineering (ME)

Kontradiktornost v trestním řízení / Contradictority in Criminal Proceedings

IN ENGLISH The purpose of my thesis is to provide an analysis of contradictority in criminal proceedings, particularly the evaluation of contradictority that is protected in penal code and its manifestation within preliminary proceeding and proceeding in court. This thesis tries to summarize the concept of contradictority in criminal proceedings and take the preparation of reform in penal code into consideration. The second chapter defines fundamental differences between inquisitional and adversarial juridical system, from which current juridical system is formed, where the contradictority is applied with some distinctions in meaning. Furthermore, the reading and the concept of contradictority in juridical system in legal study of continental legal system particularly in domestic on is discussed. In this chapter it is also analysed how courts put reading of contradictority and its definition into practice. The final part consists of reform juridical system and its relation to contradictority, especially to its protection by the basic principles in criminal proceedings. The contribution of theory and practice to the professional development of students learning to become secondary teachers in Zimbabwe

This research investigated the perceptions of student-teachers and lecturers regarding Initial Teacher Education (ITE) for secondary teachers in Zimbabwe. The ways in which factors in and between the university and school settings for ITE shaped learning to teach were investigated. Student-teachers’ and lecturers’ perceptions of the development of ideas as student-teachers moved through the different stages of training were also investigated. The study employed a qualitative case study methodology and methods - interviews, biographical questionnaires and document analysis. Data analysis began by defining a priori themes and identifying parts of the interview transcripts that were relevant to these a priori themes. The initial coding was then refined by adding additional codes which emerged from the data to create a final coding template to interpret findings. Activity Theory was used to provide a conceptual map to help describe and analyse the findings. Student-teachers had varied backgrounds and motives for joining the teacher education programme. These were often at variance with the goals of ITE. They had pre-conceived ideas about teaching from their years of schooling, prior training and work experience. Student-teachers were learning to teach in the university setting and attempting to prove their competence in school settings. In both settings students, teachers and lecturers constituted the learning communities. Relationships and availability of tools often determined the kind of support student-teachers were receiving. The factors encountered within and between the two different activity systems shaped learning to teach in various ways. ‘Taken-for-granted’ practices were not questioned and this limited the ways in which ideas presented in the university were used in the school setting. The student-teachers’ professional development, evident both to the students themselves as well as their lecturers, demonstrated not only growth in their pedagogical maturity, but also some deeper insights and the beginnings of their teacher identity. Much literature argues that learning to become an effective practitioner necessitates the use of reflective practice as a tool to resolve contradictions and for processing and internalising the complexities of boundary crossing between settings. The ‘theory-practice’ gap can be viewed as a ‘transformation space’ where teacher identity is often developed. A model to explain learning to teach made up of five elements is proposed: preconceived ideas of teaching, new ideas, contradictions, socialisation and reflective practice. The findings suggest that the university where the study was carried out should harmonise espoused practice and actual practice so that activities are consistent with the notion of concurrent learning. Concerted efforts are also needed to develop collaborative school-university partnerships, which foster reflective practice as a tool to promote professional development. Staff development programmes are needed to develop appropriate working practices. Working conditions for teachers need to be revised by the Zimbabwe government, both to encourage teaching as a desirable profession and to keep pace with changes occurring in pedagogic practice. Further research is needed to investigate how students can successfully negotiate and learn from university-school boundary crossing issues, and what sort of boundary brokers and tools are needed. Contextual factors in Zimbabwe are such that little funding is available to develop ITE. The challenge is to find innovative ways of using scarce resources to produce high quality teachers.

1 Resumé This thesis deals with the topic of "Parties to contentious proceedings". The parties involved in the dispute represent the cornerstone of any civil proceedings. Without the parties, there would be no civil procedure at all. The parties, the courts and other subjects make up the basic elements of the civil proceedings. Which is also the reason why the definition of the parties have the significant impact on the entire civil procedure. The civil procedure can be defined as a body of law that sets out the procedure rules for courts, disputing parties and other subjects, while defence to breached or threatened subjective rights and lawful interests is provided. The thesis offers a scope into the historical consequences of the concept of parties to present form along with the development of civil procedure with its changes. Besides that there is description of subjects who are involved in the civil procedure. For better differentiating a proceedings of proceedings there are listed other types of civil proceedings. This dissertation consists of a novel, The Buddha on Page 13 and a dissertation of limited extent, "Buddhist symbolism and metaphoric, and the perception of sin, guilt and punishment in The Buddha on Page 13." In the dissertation of limited extent the role that guilt plays in the motivation of an individual's actions is investigated. The Christian and Buddhist views of sin are compared, and the conclusion is made that neither Christianity nor Buddhism can explain why mankind experiences the feeling of guilt. The central character, Toit Brink, finally accepts this "so-ness" of things: "thathatha". The dissertation explains how the style of the text wishes to be neutral, and how this neutrality is harnessed for Buddhist reasons. The purpose of my thesis is to provide an analysis of the principle of contradictority and its application in criminal proceedings. I have decided to use the term "contradictory proceedings" even though The European Court of Human Rights that developed the concept usually uses the term "adversarial proceedings". The reason consists in the difference between adversarial proceedings as a special kind of criminal proceedings which is typical for countries within the Anglo-American legal culture and adversarial/contradictory proceedings as a wider concept of proceedings which is based on a respect for the rights of people charged with criminal offences and which can be (and actually is) used both within the Anglo-American legal system and the legal system of the countries in the continental Europe. In this sense, the correct translation into Czech language is "kontradiktorní řízení". The thesis is composed of six basic chapters. Chapters One and Two provide introduction, presenting some theoretical approaches to what contradictory proceedings could or should be. Chapter Three is subdivided into three subchapters. A abrangente constitucionalização, o acesso ao direito, ainda que incipiente, no Brasil, o dinamismo de uma sociedade massificada e o fluxo quase instantâneo de informações e de ideias colocaram e vem colocando em xeque o Estado enquanto provedor dos direitos básicos e, dentre eles, o acesso à justiça e a correlata função jurisdicional. Autorizado magistério doutrinário vislumbrou, como se verá, apresentar o sistema brasileiro, no que concerne à estabilização da relação processual, em específico, mais desvantagens do que vantagens. Entreviu-se, assim, oportunidade de uma revisitação do sistema processual, aproveitando-se a legislação e ideário vigentes, em uma perspectiva mais profícua e no intuito de se conferir tudo aquilo e exatamente aquilo que se busca pelo processo, enfim, maior probabilidade de pacificação. Autorizado magistério doutrinário vislumbrou, como se verá, apresentar o sistema brasileiro, no que concerne à estabilização da relação processual, em específico, mais desvantagens do que vantagens. Entreviu-se, assim, oportunidade de uma revisitação do sistema processual, aproveitando-se a legislação e ideário vigentes, em uma perspectiva mais profícua e no intuito de se conferir tudo aquilo e exatamente aquilo que se busca pelo processo, enfim, maior probabilidade de pacificação. Assim, o propósito da presente dissertação é estudar o aproveitamento da demanda quanto aos fatos dedutíveis pelas partes e que advenham ou sejam conhecidos no curso do processo como meio, então, de concretização do processo justo, um processo balizado por garantias, um processo humanizado e conforme os reclamos da sociedade hodierna. Em paralelo, estudam-se os princípios que suportam o tema, notadamente o princípio do contraditório participativo, qualificado que é pela ampla participação dos sujeitos da crise de direito material.
