Previous issue date: 2007-11-07 / The present dissertation objective the study of the dualism
modification x stability in the Constitution contexts, whose solution depends
on the perfect harmonization between the necessity of if imposing changes in
the Basic Norm and the indispensability to make it under methods that
prioritize the solidity of the constitutional text and the proper Constitution
idea.
In order to fulfill this necessity, the analysis of the proper nature of the
Lex Mater becomes necessary, its structure, essence, extension and the system
for which the rules inculpates in its body have to adapt to the dynamics of the
reality, so that if it verifies where degree such characteristics influence in the
attribute of the constitutional stability.
Equally, carefully the ways will be verified how the Constitution
suffers changes, since the adequate understanding of the formal methods
(revision and amendment) and informal (constitutional mutation) of alteration
of the basic rules in will allow to glimpse them and the narrow relation that
exists between these and the guarantee of stability of the constitutional order.
The work involves, likewise, extensive research how much to the
characteristics of origin, structure and reform of the Brazilian Constitution of
1988 and, by valuing the rationalization of the methods of constitutional
modification and detaching the irrevocably necessity of its developing fort
constitutional conscience and true will of Constitution, formulates some
proposals so that the constitutional stability also prevails in the national scene / A presente dissertação objetiva o estudo do dualismo modificacão x
estabilidade no contexto das Constituições, cuja solução depende da perfeita
harmonização entre a necessidade de se impor mudanças na Norma
Fundamental e a imprescindibilidade de fazê-lo sob métodos que priorizem a
solidez do texto constitucional e da própria idéia de Constituição.
Para cumprir esse mister, faz-se necessária a análise da própria
natureza da Lex Mater, sua estrutura, essência, extensão e o sistema pelo qual
os preceitos insculpidos em seu corpo hão de se adaptar à dinâmica da
realidade, a fim de que se verifique em que grau tais características
influenciam no atributo da estabilidade constitucional.
De igual modo, serão cuidadosamente verificados os meios através
dos quais a Constituição sofre mudanças, já que a adequada compreensão dos
métodos formais (revisão e emenda) e informais (mutação constitucional) de
alteração dos preceitos fundamentais nos permitirá vislumbrar a estreita
relação que há entre estes e a garantia de estabilidade da ordem
constitucional.
O trabalho envolve, outrossim, extensa pesquisa quanto às
características de origem, estrutura e reforma da Constituição brasileira de
1988 e, ao valorizar a racionalização dos métodos de modificação
constitucional e destacar a necessidade inderrogável de se desenvolver forte
consciência constitucional e verdadeira vontade de Constituição, formula
algumas propostas para que a estabilidade constitucional também prevaleça
no cenário nacional
