Evaluation in Higher Education, the 1988 Federal Constitution, which in its article 209
provides that the school is open to private enterprise, provided that met the
requirements of national education and subject the "assessment of quality by the
public power." He started the process of Evaluation in Higher Education Brazilian. In
1995, federal law 9.131/95, the government created the National Council of
Education, for the first time, as tasks of the MEC - Ministry of Education and Culture
has made it clear that they should formulate and evaluate the national education
politics. Since then, we passed the LDB - Law of Directives and Bases of National
Education, federal law 9.394 of December 1996, PAIUB - Institutional Evaluation of
Brazilian Universities and ENC - National College Examination, former provão , until
we get the regulatory framework Assessment of Higher Education, federal law
10.861 of 14 April 2004, SINAES - National Assessment of Higher Education. On this
track historical find over time a number of instruments used by the Ministry of
Education to accredit the functioning of new institutions of higher education and allow
new undergraduate education. The intention of this study was to analyze only the
administrative proceeding for accreditation of institutions of higher education and
undergraduate education in face mode, indicating where appropriate, the defects of
these processes, their wrongdoings and even their formal constitutions, and
therefore, providing technical legal analysis to improve administrative proceeding
analyzed / O presente trabalho estabelece como marco inicial para o resgate
histórico da Avaliação no Ensino Superior, a Constituição Federal de 1988, que em
seu Art. 209 traz que o ensino é livre à iniciativa privada, desde que cumprida às
normas gerais da educação nacional e submetida à avaliação de qualidade pelo
poder público . Estava iniciado o processo de Avaliação no Ensino Superior
Brasileiro. Em 1995, com a Lei nº 9131/95, o governo criou o Conselho Nacional de
Educação, que pela primeira vez, como atribuições do MEC Ministério da
Educação e Cultura deixou claro que deveriam formular e avaliar a política nacional
de educação. De lá para cá, passamos pela LDB Lei de Diretrizes e Bases da
Educação Nacional, nº 9.394 de dezembro de 1996, PAIUB Programa de
Avaliação Institucional das Universidades Brasileiras e o ENC Exame Nacional de
Cursos, antigo Provão, até chegarmos ao marco regulatório da Avaliação da
Educação Superior, com a Lei nº 10.861 de 14 de abril de 2004, SINAES Sistema
Nacional de Avaliação da Educação Superior. Nessa esteira histórica, encontramos
ao longo do tempo vários instrumentos utilizados pelo Ministério da Educação para
credenciar o funcionamento de novas instituições de ensino superior e autorizar
novos cursos de graduação superior. Pretende-se com esse estudo, analisar apenas
os processos administrativos para credenciamento de instituições de ensino
superior, bem como cursos de graduação superior na modalidade presenciais,
apontando, quando necessário, os vícios desses processos, suas ilegalidades
formais e até suas inconstitucionalidades, visando assim fornecer subsídios técnicos
legais de análise para melhorar os processos administrativos analisados
