A gestão democrática, diretriz prevista no Estatuto da Cidade, assegura a participação da sociedade no planejamento urbano. A dissertação trata do problema da efetividade dessa participação. Para tanto, utilizando o método do estudos empíricos, analisa as práticas dos conselhos municipais vinculados ao plano diretor de três municipalidades no Estado do Rio Grande do Sul: Porto Alegre, Caxias do Sul e Sapiranga, caracterizadas, respectivamente, como de grande, médio e pequeno porte. No plano teórico, o problema da pesquisa diz respeito à qualidade dos processos democráticos, questão enfrentada a partir dos postulados da democracia deliberativa, considerando a natureza difusa dos interesses disciplinados no Direito Urbanístico. Dentre as múltiplas variáveis que envolvem a análise da efetividade das instituições participativas, a pesquisa priorizou o estudo do viés objetivo e finalístico dos colegiados abordados, explorando sua natureza jurídica e desenho institucional, contrapondo atividades previstas e realmente executadas, fatos e normas, doutrina e práticas. A principal hipótese que orientou o desenvolvimento do estudo relacionou o problema da efetividade às pautas de fato abordadas pelos colegiados. Os resultados da pesquisa demonstraram que os conselhos, em suas atividades ordinárias, realizaram menos do que foi previsto pela legislação que os instituiu; e que essas atividades foram sobretudo pautadas por interesses de natureza individual ou coletiva, havendo ainda alto índice de matérias não deliberadas. Constatou-se também um grande descompasso entre os sistemas jurídico (federal) e político (local), devido notadamente à carência de definição uniforme sobre o desenho institucional dos conselhos. Diante desse quadro, conclui-se que as atividades dos conselhos finalmente serviram mais para instrumentalizar um modelo de política urbana, implícito ou clara e previamente estabelecido, do que para definir coletivamente seus contornos, rumos e formas de implementação e controle. / The democratic management is a legal guideline provided in a federal law, called “City’s Statute”, that ensures society’s participation in urban planning. This dissertation deals with this participation, considering its effectiveness problem. For this purpose, it was used the empirical studies method, and was analyzed the municipals councils linked to the master plan in three cities in the Estate of Rio Grande do Sul, chosen by the number of inhabitants, being characterized as large (Porto Alegre), medium (Caxias do Sul) and small (Sapiranga). The research problem is aligned to the theoretical problem about the quality of democratic processes within participatory institutions and is faced from deliberative democracy’s postulates, considering the diffuse nature of the interests disciplined in urban law. Among the many variables which involved the analysis of the effectiveness, this research faced the problem from the legal and institutional framework of municipal councils, analyzing the activities planned and really implemented, comparing theory and practice, the legal (federal) and political (municipal) systems, contrasting facts and standards. The hypothesis related the effectiveness problem to a misuse of purpose in the municipals councils activities, in order to ensure a previously established model of urban policy, instead of legitimating decisions by deliberations collectives. The survey results showed that all councils performed less activity than planned in its institutional rules and these activities attended, mostly, private interests, besides to lacking of deliberations. It was found also a large gap between the legal and political systems, notably by the lack of uniform definition of the institutional design of the councils.
