Previous issue date: 2017-05-05 / Este trabalho tem o intuito de estudar o paradoxo jurídico-político e a motivação dos Estados nas intervenções humanitárias, mais propriamente se elas são realizadas devido ao altruísmo ou como mecanismo de dominação. A fim de verificar a alternativa proposta, esta pesquisa pretendeu, através de princípios ocidentais pré-estabelecidos, bem como a percepção do outro inserido em um arcabouço normativo existente, verificar a necessidade de demonstrar, através da Teoria da Guerra Justa, a utilização do instituto nas intervenções humanitárias a fim de acabar com violações aos direitos humanos. Quem é legitimo para intervir? O que pode ser objeto que dê causa a intervenção? Quais os objetivos a serem alcançados? Outro ponto pertinente a ser compreendido deu-se sobre a contextualização dos Estados falidos entendendo pela não observância da relativização do princípio da soberania. São apresentados conceitos através de uma revisão bibliográfica com o intuito de estabelecer premissas que são verificadas nos estudos de casos com a finalidade de verificar a motivação dos Estados para conduzirem uma intervenção humanitária. / This work aims to study the legal-political paradox and the motivation of the states in humanitarian interventions, more properly if they are carried out due to altruism or as a mechanism of domination. In order to verify the proposed alternative, this research sought, through pre-established Western principles, as well as the perception of the other inserted in an existing normative framework, to verify the necessity to demonstrate, through the Theory of Just War, the use of the institute in the Humanitarian interventions to end human rights violations. Who is legitimate to intervene? What can be the cause of the intervention? Another topic is the utilization of failed states concept instead to the relativization of the principle of sovereignty. Concepts are presented through a bibliographical review in order to establish premises that are verified in the case studies in order to verify the motivation of the states to conduct a humanitarian intervention.
