Previous issue date: 2015-02-27 / A pesquisa tem como prop?sito analisar, no ?mbito da Antropologia do Direito, os
processos de constitui??o no Brasil dos Juizados Especiais Criminais-JECRIMs e visa
a discutir, a partir da realiza??o de trabalho etnogr?fico, a rela??o entre as formas e
din?micas de distribui??o de Justi?a no Brasil e no ?mbito local. Para tanto, realizouse
etnografia em um JECRIM da cidade de Natal, analisando peculiaridades advindas
dos esfor?os da ju?za coordenadora e dos outros atores do Judici?rio para trazer ?
realidade as propostas da Lei 9.099/95. A etnografia tamb?m possibilitou a an?lise
das intera??es entre os atores do Judici?rio e os jurisdicionados, acompanhados ou
n?o de advogados particulares. O arcabou?o te?rico contou com temas diversos,
abrangendo processos de judicializa??o de conflitos, an?lise de performance e de
representa??es, e rela??es entre direito, moralidade, sentimento e ritual. Busca-se
uma leitura cr?tica do atual est?gio das concilia??es e das media??es, levando em
considera??o o par?metro legal e bibliogr?fico sobre o assunto. Ao fim, ? tra?ada uma
linha geral da atua??o estatal na administra??o de conflitos, revelando algumas
aporias e contradi??es de processos volunt?rios feitos obrigat?rios pelo Estado-Punidor. / This research aims at examining, within the scope of Legal Anthropology, the
constitution processes of Criminal Small-Claims Courts-JECRIMs in Brazil seeks to
discuss, from the making of ethnographic work, the relationship between forms and
dynamics of Justice distribution both at national and local level. To do so, one
performed an ethnography at a JECRIM in the city of Natal, analyzing resulting
peculiarities arising from the works the Judge-Coordinator and all of the other Judicial
Actors in order to bring to reality the proposals of Law 9.099/95. Such ethnography has
also enabled the analysis of the interactions between both Judicial Actors and
Claimants, with or without private attorneys. The theoretical framework included
several topics, including processes of conflict legalization, performance and
representation analysis, and relationships between law, morality, feeling and ritual.
One sought to a critical reading of the current state of conciliation and mediation, taking
into account both legal and theoretical parameters on the subject. At the end, a general
guideline of State action in conflict management is drawn, revealing some aporias and
contradictions when voluntary processes are made mandatory by the State-Punisher.
