Previous issue date: 2014 / O propósito do presente trabalho é, por meio da hermenêutica filosófica, indicar elementos interpretativos que contribuam para uma adequada interpretação, aplicação e compreensão do direito ambiental contemporâneo. Parte-se da análise da inefetividade do direito ambiental, examinando sua positivação, seu enfraquecimento e o cenário que o circunda de grave crise socioambiental. Em seguida, analisa-se a incompreensão do direito ambiental pelo Poder Judiciário por meio de dois casos paradigmáticos envolvendo uma série de decisões julgadas pelo Superior Tribunal de Justiça. Os casos escolhidos foram a responsabilização pelo dano extrapatrimonial ambiental e a proibição da realização de queimadas em canaviais. Verificou-se a existência de decisões contraditórias dentro de um mesmo órgão, demonstrando a incoerência na aplicação do direito ambiental. Assim, ficou patente a imprescindibilidade de uma reformulação no modo como o direito ambiental é interpretado, o que levou à análise da hermenêutica jurídica em um terceiro momento. Analisa-se o surgimento da hermenêutica e as modificações promovidas pela hermenêutica filosófica. No campo jurídico, analisa-se o positivismo, o neoconstitucionalismo e as contribuições da hermenêutica filosófica para o Direito. Por derradeiro, são analisadas as contribuições da hermenêutica filosófica para o direito ambiental por meio de seus elementos fundamentais. Conclui-se pela inelutável necessidade de uma reformulação no campo interpretativo do direito para sua adequação às modificações na sociedade e no próprio direito nos últimos tempos.<br> / Abstract : The purpose of this dissertation is, through the philosophical hermeneutics, indicate interpretive elements that contribute to a proper interpretation, understanding and application of contemporary environmental law. It initiates with an analysis of the ineffectiveness of environmental law, examining its inscription in the positive law, its weakening and the scenery that surrounds it, a serious environmental crisis. Then analyzes the misunderstanding of environmental law by the Judiciary through two paradigmatic cases involving a series of decisions deemed by the Superior Tribunal de Justiça. The cases chosen were: responsibility in environmental moral damage and the ban on holding of fires in the sugar cane plantations. We verified the existence of conflicting decisions within the same agency, demonstrating the inconsistency in the application of environmental law. So has demonstrated the indispensability of an overhaul in the way environmental law is interpreted , which led to the analysis of legal interpretation in a third time. Then, analyzes the emergence of hermeneutics and the changes promoted by philosophical hermeneutics. In the legal field, we analyze positivism, neoconstitutionalism and contributions of philosophical hermeneutics to the right . For the last, we analyze the contributions of philosophical hermeneutics to environmental law through its fundamental elements. It concludes the inescapable need for an overhaul in the interpretive field of law for their suitability to the changes in society and the law itself in recent times.
