Previous issue date: 2016 / O tema desta dissertação é a participação de Benjamim Mota no movimento social brasileiro no início da Primeira República. Em contraposição ao tratamento ambíguo e superficial, que colaborou para enquadrar este personagem na definição de advogado anarquista , escolhi examinar com um olhar analítico desde o ambiente familiar, o interesse pela questão social e o ingresso no campo jurídico. Assim, através da redução da escala de análise, inspirada na micro-história, foi possível verificar aspectos não observados e desconhecidos sobre Benjamim Mota. A partir dos documentos históricos do cotidiano (jornais diários) foram encontrados dados sobre a tradição político-jurídica da sua família e os traços da sua formação intelectual. Delimitou-se o âmbito circunscrito de investigação espacial e temporal: São Paulo, 1901-1904, guiado pela escolha da fonte principal: a primeira fase do jornal A Lanterna. Ao seguir os indícios e rastros da experiência individual de Benjamim Mota foi constatada a defesa de uma legislação social, assistencial e jurídica para os trabalhadores e para a população carente. Paralelo a isso, o estudo minucioso sobre o grupo A Lanterna mostrou uma heterogeneidade ideológica e política, o que não impedia de haver elementos comuns entre os membros da redação, e mais que isso, o apoio a ligas de resistências, a movimentos grevistas e a denúncia a violações de direitos. Dessa forma, foi possível visualizar, sob um ângulo específico, o movimento social brasileiro e as estratégias de lutas nos primeiros anos do século XX, como também, as particularidades, contradições e adaptações do pensamento de Benjamim Mota. Como a utilização frequente e flexível do argumento do direito natural , de matriz racionalista, para legitimar tanto uma ordem jurídica constitucional quanto a sociedade anarquista futura.<br> / Abstract : The theme of this dissertation is the participation of Benjamin Mota in the brazilian social movement during the begining of the First Republic. In contraposition to the ambiguous and shallow treatment, which collaborated to frame this character as an anarchist lawyer , I chose to examine with an analytical look since the family environment, his interest for the social issue and his admission in the legal field. Thus, by reducing the scale of analysis, inspired by the micro-history, it was possible to verify unobserved and unknown aspects about Benjamin da Mota. From the daily historical papers (newspaper), data was found about the political-legal tradition in his family and his intellectual formation traces. The restricted scope of spacial and temporal investigation was delimited: São Paulo, 1901-1904, guided by the primary source choice: the first phase of the newspaper A Lanterna. By following the clues and traces from the individual experience of Benjamin Mota, the defense of a social, welfare and legal legislation for workers and needy population was detected. In parallel to this, the detailed study about the group A Lanterna showed an ideological and political heterogeneity that did not stop the appearance of common elements among the editorial staff members, and more than that, the support to resistance groups, strike movements and the denunciation of rights violation. This way, it was possible to visualize under an specific angle, the brazilian social movement and the struggles strategies during the early years of the 20th century, as well as the unique features, contradictions and adaptations of Benjamin Mota s thoughts. As the frequent and flexible use of the "natural law" argument, of a rationalist matrix, to legitimate both a constitutional law order and a future anarchist society.
