Previous issue date: 2016 / Esta tese tem por objetivo geral discutir se as teorias filosóficas tradicionais utilizadas para a justificar os Direitos de Propriedade Intelectual (DPIs), quais sejam, a Teoria Utilitarista, a Teoria do Trabalho, a Teoria Personalista, a Teoria do Plano Social e a Teoria Marxista, são capazes de validá-los como instrumentos relevantes para a apropriação da biodiversidade em um contexto de sustentabilidade. No intuito de cumprir este escopo, a partir de pesquisa bibliográfica, a tese percorre diversos terrenos teóricos e a resposta para o problema abordado é construída a partir do exame da sinergia existente entre os DPIs, a biodiversidade e a sustentabilidade. Para chegar à formulação de uma resposta para a pergunta de partida, a pesquisa está estruturada em quatro capítulos. De maneira geral, os dois primeiros capítulos apresentam o embasamento teórico dos dois eixos principais da tese, quais sejam: os DPIs e a biodiversidade. Os dois últimos capítulos são destinados à uma análise da interface desses dois temas sob a perspectiva da sustentabilidade, o que é realizado primeiramente sob uma abordagem essencialmente teórica, e, posteriormente, sob um viés dogmático. De maneira detalhada, o segundo capítulo discorre sobre a trajetória dos DPIs, a partir tanto de uma perspectiva econômica, quanto jurídica, e discute as principais teorias que justificam a sua existência. O terceiro capítulo apresenta as várias concepções existentes acerca da biodiversidade e a construção do discurso que a compreende como um recurso econômico. O quarto capítulo dedica-se a elaborar uma resposta à problemática geral da tese, discutindo a (não) justificativa do uso de DPIs para a apropriação da biodiversidade em um contexto de sustentabilidade. Embora a tese conclua pela não justificativa da apropriação da biodiversidade pelos DPIs em um contexto de sustentabilidade, o quinto capítulo apresenta diferentes instrumentos que revelam os pontos de conexão dos eixos temáticos propostos sob um ponto de vista dogmático, procurando apontar os limites e as perspectivas da sua utilização diante de uma perspectiva de sustentabilidade. De maneira geral, a resposta ao problema da pesquisa revela que a temática exige uma nova ontologia jurídica, a qual depende, por seu turno, do nível de maturidade que a noção de sustentabilidade possa atingir. Nesse sentido, a apresentação de novas abordagens, as quais buscam implementar uma forma de acesso e desenvolvimento do conhecimento em torno da biodiversidade a partir de instrumentos colaborativos influenciados pela sociedade informacional, demonstra a insuficiência do modelo tradicional de DPIs para a tutela da biodiversidade e impõe a construção de vias alternativas no intuito de garantir um futuro possível. <br> / Abstract : This thesis has the objective to discuss the traditional philosophical theories used to justify the Intellectual Property Rights (IPRs), namely, the Utilitarian Theory, the Labor Theory, the Personalist Theory, the Theory of the Social Plan and the Marxist Theory, are able to validate them as relevant instruments for the appropriation of biodiversity in a context of sustainability. In order to fulfill this scope, from literature, the thesis goes through several theoretical grounds and the answer to the problem addressed is constructed from examining the synergy between IPRs, biodiversity and sustainability. To get to the formulation of an answer to the starting question, the research is divided into four chapters. In general, the first two chapters present the theoretical basis of the two main axes of the thesis, namely: IPRs and biodiversity. The last two chapters are intended for an analysis of the interface of these two issues from the perspective of sustainability, which is carried out first in an essentially theoretical approach, and subsequently under a dogmatic bias. In detail, the second chapter discusses the trajectory of IPRs, from both an economic and legal perspective, and discusses the main theories that justify their existence. The third chapter presents the various existing conceptions of biodiversity and the construction of the speech that includes it as an economic resource. The fourth chapter is dedicated to preparing a response to the general problem of the thesis, discussing the (non) justification of the use of IPRs for the appropriation of biodiversity in a context of sustainability. Although the thesis concludes that there was no justification for the appropriation of biodiversity by IPRs in the context of sustainability, the fifth chapter presents different instruments that reveal the connection points of the proposed themes in a dogmatic point of view, trying to point out the limits and perspectives of its use before a sustainability perspective. In general, the answer to the problem of the research reveals that the subject requires a new legal ontology, which depends, in turn, on the level of maturity that the notion of sustainability can achieve. In this sense, the presentation of new approaches, which seek to implement a form of access to and development of knowledge about biodiversity from collaborative tools influenced by the information society, demonstrates the failure of the traditional model of IPRs for the protection of biodiversity and imposes the construction of alternative routes in order to ensure a possible future.
