Previous issue date: 2016 / Este trabalho investiga onde está posta e como se dá a fronteira entre o instituto da autonomia universitária e as competências dos órgãos de segurança pública, ambos temas postos na Constituição Federal de 1988 e legislação esparsa. Nesta perspectiva, faz-se uma revisão, na legislação e na doutrina, sobre os temas e aqueles a eles conexos, para que se chegue, ao final, numa compilação ou sistematização daquilo que mais importa, ao gestor da universidade, saber quando diante de questões de segurança pública. O material resultante da pesquisa pretende indicar soluções ou condutas acompanhadas dos devidos embasamentos técnico, teórico e histórico para que os envolvidos na gestão universitária compreendam de que maneira a instituição universitária pode ou não atuar no tema, bem como de que forma precisa se relacionar com outras figuras da Administração Pública para dar conta da matéria. Para tanto, parte-se, em caminhada dedutiva, do surgimento e consolidação do Estado até sua forma brasileira atual, com a devida organização administrativa e distribuição de funções por diversos níveis e figuras da Administração Pública feita pela Constituição Federal de 1988 para, em seguida, analisar-se o processo de evolução histórica das universidades e do ideal de sua autonomia até que figurassem como temas também constitucionais e, depois, analisa-se a esquematização, pelo constituinte, de um rol exaustivo de órgãos para o complexo campo da segurança pública e a competência atribuída a cada um destes. O trabalho trata de tema emergente na administração universitária brasileira e, por dizer respeito à relação desta instituição com outras, liga-se à linha de "Universidade e Sociedade" do Programa de Pós Graduação em que se insere.<br> / Abstract : This work aims to investigate the boundaries between the institute of university self-governance and the jurisdiction of public security bodies, where they are and how they work, both themes considered by the Federal Constitution of 1988 and further legislation. In this perspective, a revision of legislation and doctrine is developed on these topics and on related ones, to reach a compilation or systemization of what is most important for a university administrator to know about public security matters. Material resulting from this research pretends to indicate
solutions or practices supported by proper technical, theoretical and historical bases, so that people involved with university administration understand how the institution may or may not act about these matters, and to indicate how it needs to relate with other Public Administration bodies to deal with this issue. To achieve its objective, the research starts with a deductive path from the birth and consolidation of the State until its modern Brazilian declination, with its proper administrative organization and distribution of functions on different levels and figures of the Public Administration, determined by the Federal Constitution of 1988. Hereupon, the historical evolution process of universities is analyzed together with their self-governance ideal, until these themes resulted constitutional as well, and then the schematization by the constituent of an exhaustive list of bodies for the complex field of public security, which are analyzed with the responsibilities assigned to each of them. This work is about emerging themes in the Brazilian university administration and, being about relationships between this institution and others, is linked to the line of University and Society of the Post-Graduation Program which is part of.
