Previous issue date: 2017 / Este trabalho tem o objetivo de analisar as injunções de uma ordem hegemônica assentada sobre o capital fictício em aspectos do direito brasileiro no contexto que se segue ao advento da Constituição de 1988. Para tanto, inicia-se por situar a categoria capital fictício no âmbito da construção teórica de Karl Marx, especialmente em O capital, e a partir das formulações contidas no Livro III. Em seguida, trata-se de elementos do processo histórico pelo qual o capital fictício estabelece sua hegemonia no plano mundial e, em particular, no Brasil, configurando um padrão de desenvolvimento dirigido pelas formas fictícias de acumulação, cuja expressão mais marcante reside, após o advento do Plano Real, em um sistema de endividamento público. A ênfase da abordagem das questões jurídicas, nesse contexto, recai sobre as contradições entre a constituição econômica e o projeto dirigente que emergem como resultado normativo do processo constituinte de 1987-1988 e as relações concretas observadas no pós-constituinte ? em que se verifica a subsunção dos princípios da ordem econômica e dos direitos sociais às necessidades e condições asseguradoras de remuneração do capital fictício ? e o papel de resignação ativa desempenhado pelo Supremo Tribunal Federal nesse contexto. Em conclusão, verifica-se que, para além de conteúdos incompatíveis com o projeto dirigente que resulta do processo constituinte de 1987-1988, as exigências postas por um padrão de desenvolvimento baseado nas esferas fictícias de acumulação remetem a uma temporalidade complexa e acelerada, cuja gestão interdita a efetivação de disposições constitucionais expressas no que diz respeito aos princípios da ordem econômica e aos direitos sociais.<br> / Abstract : The aim of this work is to analyze the demands presented by a hegemonic order, which was based on the fictitious capital, in aspects of the Brazilian law emerged from the circumstances that followed the advent of the 1988 Constitution. In order to do so, the thesis begins by situating the fictitious capital category within the scope of Karl Marx?s theory, especially in Capital, and from the formulations contained in Volume III. Then, it deals with the elements of the historical process through which the fictitious capital established its hegemony on a global level and, in particular, in Brazil, by shaping a pattern of development conducted by fictitious forms of accumulation, of which the most outstanding expression resides, after the advent of ?Plano Real?, in a public debt system. The emphasis of the approach to the legal issues, in such context, lies both on the contradictions between the economic constitution and the directive project that emerged as the legal result of the 1987-1988 constitutional process and the concrete relations observed in the post-constituent period? in which it is possible to watch the subsumption of the principles of economic order and social rights to the needs and conditions that ensure the remuneration of fictitious capital ? and on the role of active resignation played by the Supreme Court in this context. In conclusion, it is possible to observe that, further beyond the contents incompatible with the directive project arose from the 1987-88 constituent process, the demands presented by a pattern of development based on the fictitious spheres of accumulation relate to a complex and accelerated temporality, the management of which prohibits the implementation of expressively stated constitutional provisions regarding principles of the economic order and social rights.
