Previous issue date: 2017 / O presente estudo é voltado à discussão da categoria ?comércio justo?, que constitui uma nova modalidade de fazer comércio baseada no princípio da sustentabilidade ? em suas faces econômica, social e ambiental ? como fundamento do negócio jurídico. É regida por princípios éticos e solidários, voltados à justiça social, desde o âmbito local até a dimensão internacional. Essa concepção distingue-se do comércio tradicional uma vez que este é regido por princípios, muitas vezes, não legitimados pela sociedade internacional. Aquela vertente, a seu turno, trata-se de uma manifestação da Justiça Global que, delineada no contexto da globalização, visa fortalecer a sociedade civil e os movimentos sociais, intensificando o fenômeno do transnacionalismo e do pluralismo jurídico. Isso ocorre porque, desde a formação dos Estados, as relações comerciais expandiram-se para âmbito internacional consolidando o sistema capitalista ? em um primeiro momento sob a lógica mercantilista ? o qual, inserido no processo de globalização, acarretou em mazelas sociais para toda sociedade. Sendo assim, o objetivo geral é verificar se o comércio justo pode ser instrumento da Justiça Global, sob lógica distinta do comércio mundial tradicional (free trade). Quanto aos objetivos específicos, intenta contextualizar a formação sistêmica do comércio mundial, caracterizar a Justiça Global e indicar as contribuições do comércio justo para a sua afirmação. A abordagem metodológica utilizada foi o método hipotético-dedutivo. A hipótese central é a de que o comércio justo pode ser instrumento da Justiça Global, contrapondo-se ao comércio mundial, dito tradicional, regido pelo multilateralismo e por irrestrita liberdade, sob os auspícios do capitalismo.<br> / Abstract : The present study focuses on the discussion of the so-called category ?fair trade?, which is a new way of trading that is based on the principle of sustainability ? in its economic, social and environmental aspects ? as the basis of the legal transaction. It is led by ethical and solidarity principles, focusing on social justice from the local to the international dimension. This modality differs from the traditional trade because the last one is ruled through principles that usually are not legitimated by the international society. The other one, in its turn, it?s a manifestation of Global Justice, that, outlined in the context of globalization, aims to strengthen civil society and social movements, intensifying the phenomenon of transnationalism and the legal pluralism. This occurs because, since the formation of States, trade relations have expanded internationally, consolidating the capitalist system ? at first under the mercantilist logic ? which, entangled in the process of globalization, has led to social ills for every society. Therefore, the general objective is to verify if fair trade can be an instrument of Global Justice, under a different logic from the traditional free trade?s one. As specific objectives, the study intends to contextualize the systematic formation of global trade and to characterize Global Justice and to indicate the contributions of fair trade to affirm it. About the methodology, it was used a hypothetical-deductive approach. The central hypothesis is that fair trade can be an instrument of Global Justice, in opposition to the so called traditional free trade, governed by multilateralism and unrestricted freedom, under the auspices of the capitalism.
