Consequentemente, surgiram novos instrumentos jurídicos sobre o tema, que aumentaram o nível de protetividade e abrangência deste sistema. O objetivo principal deste trabalho é analisar como a tutela internacional sobre o Direito Autoral se comportou diante das novas formas de acesso às obras fonográficas. Para tanto, no primeiro capítulo, é verificado como se desenvolveu a revolução industrial e, mais recentemente, a revolução da tecnologia da informação, com a construção da sociedade informacional e as consequentes mudanças de paradigmas em relação às formas de acesso das obras fonográficas. É analisada também a evolução dos suportes dos fonogramas, desde a criação do fonógrafo e os discos de cera até o formato mp3. No segundo capítulo é estudado como se desenvolveu o Sistema Internacional de Propriedade Intelectual e, mais especificamente, Direito Autoral, em relação mais especificamente às obras fonográficas. Os objetos são as principais convenções e tratados internacionais sobre o tema, a fim de compreender a relação entre as mudanças tecnológicas e as alterações na tutela das obras fonográficas, além de analisar se foram feitas mudanças significativas nos tratados internacionais para abranger as novas formas de acesso às obras fonográficas. Estas serão analisadas especificamente no terceiro capítulo, sob a ótica da teoria sobre as culturas da internet de Castells. Nesta parte final do trabalho serão analisados casos práticos importantes para compreender como se aplica a realidade informacional em relação aos fonogramas. Por fim, são trazidas as conclusões decorrentes da pesquisa. / Since the beginning of the International Copyright System in the late nineteenth century, there was an important evolution of the topic, wich has become vital for the economic and social development. Consequently, there have been new legal instruments on the subject, which increased the level and scope of this protective system. The main objective of this study is to examine how the international protection of the Copyright behaved before new forms of access to phonograms. Therefore, in the first chapter, is checked how the industrial revolution was developed and, more recently, the construction of the informational society and the resulting phonograms access paradigm shifts. It also analyzed the evolution of the supports of phonograms, from the creation of the phonograph and wax discs to MP3 format. In the second chapter we study how it developed the International Intellectual Property System and, more specifically, copyright law, especially in relation to the phonograms. The objects are the most important international conventions and treaties on the subject in order to understand the relations between technological evolution and the protection of phonograms, and examine whether significant changes have been made in international treaties to cover new forms of phonograms access. These will be analyzed specifically in the third chapter, from the perspective of the Castells theory about the Internet cultures. In this part, important cases are reviewed in order to understand how it applies the informational reality in relation to phonograms. Finally, the conclusions from the research are brought.
