O presente trabalho versa sobre o desenvolvimento da genética com a aplicação na tecnologia de obtenção de perfis genéticos e sua catalogação em base de dados para fins criminais. Através de um estudo analítico e interpretativo das informações coletadas, o trabalho identifica os principais conflitos existentes na catalogação da informação genética nessa base de dados e, propõe uma discussão com referenciais bioéticos sobre a legitimidade dessa catalogação. Os referenciais bioéticos utilizados foram: os princípios de respeito à autonomia, privacidade, confidencialidade, equidade e justiça. Contextualizado com a bioética, fez-se um estudo com os rincipais tratados internacionais de proteção à informação genética e concepções bioéticas e as normas nacionais de autorização da implantação do banco de dados genéticos no Brasil. O trabalho também propôs uma discussão, sob o enfoque da biopolítica e biopoder, sobre a regulamentação estatal das amostras de perfis genéticos e a soberania da gestão disciplinar do biológico da população. Esse trabalho também propõe a inclusão de interpretações da bioética no contexto discursivo da biopolítica, interpretando os fenômenos de ordem biopolíticos sob os vieses contemporâneos da bioética. Conclui-se, assim, que as vantagens oferecidas por esse tipo de bancos de dados para a investigação policial são inúmeras, funcionando como uma ferramenta de grande eficácia para a elucidação de crimes. Portanto, em relação aos princípios da bioética, a catalogação dos dados genéticos em bases de dados informatizadas para elucidação de crimes não fere o respeito à autonomia, pois há uma previsão legal nessa ordem, como também não interfere na privacidade e confidencialidade do indivíduo, pois dão condições técnicas e operacionais claras da não interferência humana à informação individual. E, de fato, preserva a justiça do ato, ao estabelecer limites na conduta humana, pois tem o propósito de apenar o indivíduo condenado a ter sua inclusão no banco de dados genéticos. Em relação à biopolítica, verifica-se que esses instrumentos analíticos de biopoder não pretendem desqualificar a importância do princípio da dignidade da pessoa humana e a garantia de sua autonomia, pois há, por parte do Estado, as garantias primárias da não interferência e sigilo na informação genética catalogada. _______________________________________________________________________________________ ABSTRACT / Databases of genetic profiles are structured sets of results of analyzes of genetic profiles kept usually in a computerized database. This work is about the development profiles kept usually in a computerized database. This work is about the development of genetics with the application in the technology of obtaining genetic profiles and their cataloging in database. Through an analytical and interpretative study of information collected, the study sought to identify the main conflicts in the ctaloging of genetic information in the database, and proposes a bioethical discussion with bioethical references about the legitimacy of this cataloging. The bioethical references that were used were: the principles of respect for autonomy, privacy, confidentiality, fairness and justice. Contextualized with the bioethics, a comparative study was done with the major international treaties for the protection of genetic information and bioethical conceptions and national standards for authorization the implementation of genetic database in Brazil. It also proposed a discussion with a focus on biopolitics and biopower about state regulation of the samples of genetic profiles and the sovereignty of the disciplinary management of the biologic of the population. Finally, this work also proposes the inclusion of interpretations of bioethics in the discursive context of biopolitics, interpreting the phenomena of biopolitical order under the biases of contemporary bioethics. We conclude, therefore, that the advantages offered by this type of databases for police investigation are numerous, functioning as a highly effective tool for the elucidation of crimes. Therefore, in relation to the principles of bioethics, the cataloging of genetic data in computerized databases for elucidation of crimes does not hurt respect for autonomy, because there is a legal provision in that order, it also does not interfere in the privacy and confidentiality of the individual, because it provides clear technical
and operational conditions from the non-human interference to the individual
information. And indeed, it preserves the justice of the act, when it sets limits on human behavior as it has the purpose of penalizing the sentenced individual to have his inclusion in genetic database. In relation to biopolitics, it is verified that these
analytical tools of biopower do not intend to disqualify the importance of the principle of human dignity and the guarantee of their autonomy, as there are, by the state, the primary guarantees of non-interference and confidentiality of cataloged genetic information.
