A internação ocorre na Ala de Tratamento Psiquiátrico localizada no Presídio Feminino do Gama e o tratamento ambulatorial, na rede pública de saúde do Distrito Federal. Ambos os tratamentos são acompanhados pela Seção Psicossocial da Vara de Execuções Penais do Tribunal de Justiça do Distrito Federal e Territórios. Essa fala é investigada por intermédio da escuta clínica, balizada pelo olhar psicanalítico e pela ética que visa à pessoa em primeiro lugar. Como instrumento de investigação, utilizamos os verbos pathicos – os quais são o verbo querer e os verbos modais (poder, dever ser, permitir-se, dever ter/necessitar), articulados aos pronomes. Esses verbos servem para modalizar pensamentos, que ocorrem na mente da pessoa e que podem se tornar atos. A origem do ato está na luta entre necessidade e liberdade, entre dever e querer. O supereu freudiano, enquanto “dever ser”, e processos defensivos utilizados pelos sentenciados também são investigados com o objetivo de se examinar o devenir de cada um deles. Este trabalho visa a um diálogo inicial com o modo com que cada um experiencia o mundo e reage a essas experiências. Percebemos que é possível pensar o conflito advindo da natureza e da cultura por intermédio dos verbos pathicos. Ademais, trabalhar a fala e a vivência de cada um perpassa o estudo desses verbos, que, como anteposto, dizem respeito à pessoa. Nesse sentido, a interlocução entre o direito e a psicanálise é essencial como possibilidade de construção de outro discurso, de uma fala que busque a aquisição de autonomia e responsabilização. _______________________________________________________________________________________ ABSTRACT / The present study aims to investigate the speech of the unimputable and the semi- imputable, serving a juridical sentence of internment or of ambulatory treatment for security measures. The internment occurs at the Psychiatric Treatment Ward, which is located at the Female Prison in Gama, and the ambulatory treatment occurs in the public health service of the Federal District. Both are accompanied by the Psychosocial Section of the Criminal Executions Court of the Federal District Court of Justice. This speech is investigated by the clinical hearing, guided by psychoanalysis and by the ethic which considers the person in the first place. As an instrument of investigation, we will use the pathic verbs – which are the verb “to want” and the modal verbs (can, should, may, must), linked to pronouns. These verbs are used to indicate modality, which occurs in the person’s mind and which may become actions. The origin of the act resides in the dispute between necessity and liberty, between should and want. The Freudian superego, as a “should”, and defensive mechanisms used by the condemned persons are also investigated in order to examine the psychic process of each one. This study seeks an initial dialogue with the way each one of these persons experiences the world and reacts to these experiences. It is noticed a possibility of thinking the conflict arising from nature and culture by these pathic verbs. Moreover, work with the speech and the experience of each one of them pervades the study of these verbs because, as stated, they are related to people. Therefore, the interlocution between Law and Psychoanalysis is essential as a potentiality of building another discourse, a speech that seeks an acquisition of autonomy and responsibility.
