Previous issue date: 2009-06-26 / O Brasil vem experimentando uma nova forma de planejamento urbano, centrada em valores sociais e inclusivos e, sobretudo, no princípio constitucional da função social da propriedade. Os instrumentos urbanísticos, em sintonia com esse momento, são as ferramentas de que dispõem as cidades para materializar princípios cunhados no âmbito de movimentos sociais, voltados para a gestão social e contrários à concepção especulativa da propriedade urbana. A outorga onerosa de alteração de uso é uma dessas ferramentas, disciplinadas pelo Estatuto da Cidade, à disposição das cidades para dinamizar os espaços urbanos, tornando-os mais adequadas às necessidades coletivas. Entretanto, o instrumento possui, do mesmo modo, potencial para incrementar o valor das propriedades, o que o torna alvo de constantes ações de proprietários e do mercado imobiliário e, em conseqüência, do jogo político. As condições urbanísticas peculiares encontradas no Plano Piloto e nos núcleos urbanos mais próximos fizeram desses espaços uma aspiração natural, o que resulta em estratégias de inserção e permanência materializadas por alterações de uso. Conjugados - “quitinetes” - em zonas comerciais, comércio em zonas residenciais, atividades produtivas licenciadas fora do zoneamento original, intensa produção de leis que transformaram o uso de lotes comerciais para abrigar postos de gasolina, decisões judiciais que reverteram os usos originais, etc. Há um grande volume de conflitos que envolvem uma prática que contradiz as normas de uso e ocupação do solo. Entretanto, se à primeira vista parece tratar-se de simples formas individualistas de utilização das propriedades, por outro lado, parece questionar a forma como o planejamento vem vislumbrando os espaços urbanos ao longo do tempo. Ao analisar mais detidamente a ocorrência de alterações de uso de imóveis no DF, os interesses e a “queda de braços” entre gestão social e práticas voltadas a interesses individuais, existente nos bastidores da aplicação do instrumento, o trabalho pretende contribuir com o entendimento e enfrentamento dos problemas urbanos por parte dos órgãos de planejamento e gestão. Afinal, como se dá a captura dos valores gerados com alterações nas regras de uso? Qual a lógica que fundamenta a aplicação prática do instrumento? Apropriação individual ou gestão social? __________________________________________________________________________ ABSTRACT / Brazil has been experiencing a new way of urban planning, centered on social and inclusive values, above all on the constitutional principle of the social function of property. Urban tools in sync with this moment are essential tools at the city’s disposal’s to materialize principles grounded by social movements, leaning towards social management and contrary to the speculative nature of urban property. The charged grant for altering the original use of the land is one of these mechanisms, regulated by the City’s Bylaw, at each city’s disposal to maximize the use of urban spaces – making them more adequate to the needs of its citizens. However, this very mechanism can, in the same way, have the power to increase the value of properties – which makes it the ideal target for constant lawsuits and real estate speculator to juggle with the legislation as a consequence of the political game. The unique urban conditions found in the Plano Piloto and in its closest surrounding urban areas have made them, a natural contender to the ongrowing desire of real estate expansion, which results in strategies of insertion and permanence made real by alterations in the usage of these regulations. Kitchenettes located in commercial areas, shops in residential areas and licensed labor activities out of their original designated plot zone in the original configuration of the city – all these result from an intense production of laws and/or judicial decisions which transformed the use of commercial areas into gas stations or even reversed the primary uses of the original areas. There is an array of conflicts involving a practice that contradicts the rules of usage and occupation of the above mentioned areas. In spite of what it seems, if at first it seems to be an individualist take on how the properties are utilized, on a second look, one is led to the questioning of the way this urban planning has been carried out so far through a long time perspective. Throughout careful analysis of the frequency of the alteration of the primary use of real estate properties in DF, personal interests and the real ‘tug of war’: social management versus the practice focused on the individual agenda – which clearly exists behind the implementation of the instrument – this research intends to contribute to the understanding and facing of urban problems met by urban planning and urban management agencies. After all, how are resources generated and captured with alterations in the rules of usage? What logic fundaments the practical application of the mechanism? Individual appropriation or social management?
