Previous issue date: 2006-08-01 / Este estudo teve como motivação buscar respostas à questão de se é possível que as leis e normas previstas em relação às pessoas com deficiência venham a ser observadas e quais os fatores que aí comparecem. Para isto, trabalha com o conceito do direito natural, explora o conceito da tolerância, apresenta as normas relativas à área das deficiências no âmbito das Nações Unidas e no âmbito da legislação federal brasileira, e discute a questão das necessidades humanas. Tem por objetivo estimar a inclusão das pessoas com deficiência na sociedade, a partir das políticas públicas implementadas pelo governo federal brasileiro, e para isto, apresenta o dispêndio e a ação pública federal na área nos anos recentes, até 2004, e mostra a programação orçamentária para o Plano Plurianual 2004-2007. Conclui que o dispêndio realizado na área é insignificante e que a existência de penalidades atuaria positivamente para que houvesse respeito à legislação. _______________________________________________________________________________ ABSTRACT / The motivation of this study was the search for answers referring to if the foreseen laws and norms in regard to people with disabilities have been complied with and which are the factors that come up in this respect. Therefore, the survey looks into the natural right concept, it explores the tolerance concept, illustrates rules concerning the disability within the scope of the United Nations and within the scope of the Brazilian federal legislation. Moreover, the study raises the question of human needs as it aims to estimate the inclusion of disabled people into society based on public policies implemented by the Brazilian government. Thus, the paper presents expenditure and government action in this regard over recent years, up to 2004, furthermore, the budget plan for the Pluri-annual Plan 2004 – 2007 is revealed. It has been concluded that the expenses undertaken in this field are insignificant and that the existence of punishment would contribute positively so that there might be more respect for the legislation.
