2009_CynthiaRejanneCorreaACiarallo.pdf: 3089083 bytes, checksum: b5a0b5a6f3465f0cd5fcf9d27c32b61d (MD5) / Nesta tese são analisadas relações institucionais que se estabelecem entre a práxis psicológica e a práxis jurídica e possíveis impactos na produção de práticas, discursos e subjetividades no exercício profissional do psicólogo judiciário. Faz-se interlocução com abordagens teóricas do campo da história da psicologia, da psicologia jurídica, da psicologia institucional e da ciência jurídica. A partir da proposta epistemológica que dá sustentação à pesquisa qualitativa, foram realizadas entrevistas com quatro magistrados e quatro psicólogos que atuavam como assessores técnicos aos primeiros em um Tribunal de Justiça. A análise se pautou em três eixos: o objeto institucional (justiça), o âmbito de ação da instituição e os atores institucionais (juízes e psicólogos) e indicou que o psicólogo judiciário tem, predominantemente, concebido o sujeito através de uma lente sóciojurídica, adequando à instituição suas estratégias de intervenção, atuando como controlador da moral que investiga, decifra o sujeito e busca conscientizá-lo para a direção da norma jurídica, sem questioná-la. Além disso, o psicólogo considera seu trabalho importante na atividade-fim da organização e procura fazê-lo com compromisso ético e técnico, em harmonia com a práxis jurídica.Tais práticas e modos de subjetivar seu lugar indicam o que neste trabalho é chamado de mimetização da práxis psicológica no contexto da Justiça. _________________________________________________________________________________ ABSTRACT / In this thesis it is analyzed the institutional relations which are set within psychological and juridical praxis, as well as its impacts in the production of practices, discourses and subjectivities in the judicial psychologist profession. As for the conceptual basis of the research, dialogue is made with the theoretical approaches of the history of psychology, judicial psychology, institutional psychology and juridical science. From the epistemological perspective that feeds qualitative research, interviews were performed with four judges and four psychologists that worked as technical consultants in a judicial context. The analyses was made considering three focuses: institutional object (justice), the realm of action of the institution and institutional actors (judges and psychologists), and revealed that the judicial psychologist has seen individuals through social-juridical lens, making their practices of intervention more adequate to the institution, once they act as to control a morality that investigates, translates individuals and seeks to aware them in the direction to juridical rules, without questioning them. Beyond that, the psychologist sees their professional activity as being important to the final activity of the organization, making it committed to ethic and technical standards, in harmony with juridical praxis. Such professional practice and forms of subjectivity indicate what in this research is called mimicry of the psychological praxis in the judicial context.
