2008_GilselyBarbaraBarretoSantana.pdf: 1045208 bytes, checksum: ba33b36239ed03221ab680c0f8dd30bd (MD5) / A construção do projeto de nação brasileira perpassa pela afirmação sócio-juridica de um modelo eurocêntrico que historicamente preteriu grupos e experiências sociais distintas. A questão quilombola no Brasil contemporâneo refere-se à luta por reconhecimento de elementos étnicos e identitários na forma de apropriação e relação com os recursos naturais, conformando os conceitos de território e processos de territorialização, distinguindo da concepção individual e privatista de propriedade. Neste sentido, o direito tem sido visto como o obstáculo para garantir o direito das comunidades, especialmente, pela base individualista do sistema de direito e os limites frente à referida experiência. Contudo, a Constituição Federal de 1998 se insere no processo de ampliação de direitos da sociedade brasileira, no qual, afirmam-se a diferença e o caráter pluriétnico do país, como explicitado no art. 68 do ADCT que reconhece a propriedade das terras aos quilombolas. Portanto, a questão quilombola e a condição de proprietária atribuída às comunidades trazem novos elementos para repensar a categoria jurídica propriedade na contemporaneidade, mas também, e sobretudo, requer uma ressignificação do conceito e função da propriedade constitucionalmente consubstanciado, em face do contexto social plural e democrático que tem o desafio de assegurar direitos aparentemente contraditórios. _________________________________________________________________________________ ABSTRACT / The construction of the project of Brazilian nation passes by the social and juridical affirmation of an Eurocentric model that historically neglected groups and distinct social experiences. The quilombola question in the contemporary Brazil refers to the struggle for recognition of ethnic and identity components in form of appropriation and relation with the natural resources, conforming the concepts of “territory” and “process of territorialization”, and distinguishing them of the individual and privative conception of property. Furthermore, the law has been seen as an obstacle to guarantee the communities’ rights, especially for the individualist bases of law system and its limits in front of reported experience. Nevertheless, the Federal Constitution of 1988 inserts itself in the process of enlargement of rights in the Brazilian society, in which the difference and the pluriethnical character of the country are affirmed, as expressed in the art. 68 of ADCT, which assign the property of land to the quilombolas. Thus, the quilombola question and owner condition) assigned to the communities bring new components to rethink the juridical category “property” in the contemporaneity, but above all they also ask for a ressignification of the concept of property and its function constitutionally consubstanciated, in the face of plural and democratic social context, which has the challenge of assuring apparently contradictory rights.
