2011_EricaMattosdaVeiga.pdf: 886527 bytes, checksum: 6dba610279c9482fd8484b437ecdfa6c (MD5) / Debates e negociações internacionais relativos a temas de ‘saúde internacional’, assim como aqueles dedicados ao tema ‘direitos privados de propriedade industrial’, são caracterizados pela falta de transparência, distorção e resistência a argumentos que contrariem o discurso hegemônico sustentado por corporações multinacionais. Uma das principais características desse discurso é negar a validade e aplicabilidade de argumentos éticos e princípios jurídicos de direito econômico, como a função social da propriedade e a responsabilidade social da empresa, à atividade empresarial no setor farmacêutico. Debates relativos à conceituação hegemônica de institutos de propriedade industrial (como patentes farmacêuticas e informação nãodivulgada) e à pertinência de políticas públicas de saúde (como o registro simplificado de medicamentos genéricos e a sujeição de produtos a vigilância sanitária e regulação de preços) demandam honestidade intelectual, ambiente democrático, argumentos transparentes e competentes tecnicamente. A verdadeira compreensão dos impactos, em termos de desenvolvimento econômico e inovação, da concessão e gestão de direitos de propriedade industrial, consideradas específicas conjunturas sócio-econômicas, exigem complexas análises empírico-econômicas destes institutos (Machlup e Penrose, Stiglitz). A ruptura com o discurso hegemônico, e conseqüente incorporação da ética no rol de expectativas normativas (Luhmann) incidentes sobre agentes econômicos do setor farmacêutico, somente será alcançada por meio da contínua promoção de debates (Perelman), capazes de esclarecer conceitos e seus conteúdos (Wilson). Da atuação ética em negociações multilaterais poderá resultar a necessária racionalidade vinculada à cooperação em relações sociais, à qual se referem as teorias da justiça de Gauthier e Rawls, conditio sine qua non para a construção do paradigma de uma nova globalização na qual direitos humanos fundamentais se equilibrem com interesses econômicos e comerciais (Stiglitz). A dissertação utiliza como ferramenta teórica adequada ao estudo das políticas públicas e suas relações com a diplomacia, a Bioética Latino-Americana de Intervenção, objetivando a desconstrução do discurso hegemônico simplista aplicado, na atualidade, à interface direito fundamental a saúde/privilégios de propriedade industrial. _________________________________________________________________________________ ABSTRACT / International debates and negotiations related to themes of ‘international health’ and ‘private rights of industrial property' are characterized by a lack of transparency, distortion and resistance to arguments contrary to the hegemonic discourse supported by multinational corporations. A key feature of this discourse is the denial of the validity and applicability of ethical arguments and legal principles of economic law, especially in relation to the pharmaceutical sector, as the social function of property and the corporate social responsibility in the pharmaceutical sector. Debates related to the hegemonic concepts of intellectual property (such as pharmaceutical patents and undisclosed information) and to the pertinence of health public policies (such as the simplified registration of generic medicines and the health surveillance of products and the regulation of their prices) demand intellectual honesty, a democratic environment and transparent and competent technical arguments. A true understand of the impacts in terms of economical development and innovation, of the grant and management of intellectual property rights, considered specific socio-economic conjunctures, demand complex economical/empirical analysis of these tenets (Machlup e Penrose, Stiglitz). The break with the hegemonic discourse and the consequent inclusion of ethics within the normative expectations (Luhmann) levied on the economic agents of the pharmaceutical sector will only be achieved through the promotion of continuous debates (Perelman) which are able to clarify concepts and their substance (Wilson). Ethical behavior in international forums and multilateral negotiations may rise from the demonstration of the rationality inherent in cooperation in social relations mentioned in the theories of justice by Gauthier and Rawls. This rationality is conditio sine qua non for the construction of the paradigm of a new globalization era in which fundamental human rights are balanced with economic and commercial interests (Stiglitz). The present dissertation utilizes as a theoretical tool the framework of Intervention Bioethics (Bioética Latino-Americana de Intervenção) for the study of public policies and its relations with diplomacy. The objective of the dissertation is the deconstruction of the simplistic hegemonic discourse applied today to the interface the fundamental right to health/ the privileges of industrial property.
